Can I smoke my medical marijuana in my parked car in a shopping center parking lot?

Of course the car would be off and the keys in my purse. There are no daycare centers in this shopping center. I do not want to drive after smoking, so I figured I'd drive there, turn off the car, put away the keys, and medicate there. Is that ok? Should I worry? Logically it seems the safe option but I don't want any problems. Thanks.

You ask if you can, but know your not allowed to, and add some supportive points but the bottom line is even if your a medical user if your smoking in public which in a parked car in a shopping center parking lot would be considered in public.

The law states you cant smoke in public.

as far as worrying that up to you.

I reciently got a vape and its a home ac powered unit and have had it for only 3 weeks and am still seeing what works best for me.
I bought the vape mainly for the healthier alternative to smoking. and found that it is also stealthy in that the vape smell compared to smoke smell are 2 night and day differenced smells. the vape is a less noticable scent therefore the stealth.

I read on another board of 2 guys that got pulled over after just vaping for no seatbelt, and the officer didnt smell or suspect a thing. yet try just smoking some dank bud and the officer will start looking for the evidence of what he is smelling.

There is a very efficent vape out there called 'Purple Days' that comes with both a home ac adapter and a car cord. is sized the same as a soda can shape so sould be small enough to stash under you seat out of site if need be. but the purpledays has a 3-4 month waiting list ( its a very popular vape among vaping enthusiast's) I want to get one but dont want to deal with a 3 month wait. perhaps in a few more months the builder will be caught up.

The law states that you can not medicate in a moving vehicle. As long as you are not near a school or the othe areas stated that are no smoking in prop. 215 you should be fine.

Yeah even though your car is on public property, you being in the car still makes it so you are in your own personal property in most instances. Everything's up to officer's discression though, so if they want to arrest you for something there's not much you can do about it.

Ok well if thats the case I hope you have some limo tinted windows so you are unseen but what of the odor? if your smoking and your windows are closed depending on how much your toking when you get out it could look like a scene from a cheech and chong movie and stink so beware when you exit and make sure you dont see any one down wind from you.

If a cop rolls up on you, your car smells like weed, and you are unable to complete the roadside test, things could start looking really bad. A friend of mine was sitting in his car (not on or anything), not even smoking, and a cop shows up. Sees an empty pipe and gives him the test, he fails one of them and got his car taken away and went to jail. If anything, just try edibles. You can eat those in front of a cop. =)

Then don't smoke where you can be seen.

If you want to smoke in your car safely, do it in the garage with the door closed.

Your just asking to get busted, card or not.

I agree....no matter what if they want to mess with you they can. Having your 215 card helps protect you....but the laws are so vague from county to country. I'd recommend if you did smoke in public (your car in a parking lot)....be very discreet! :jointsmile:

i myself wouldnt take the chance! law enforcment just look for stuff like that, you would be a sitting duck for them, and get ahold of a real jerk and your day is ruined,its tempting i know but not worth the chain reaction they would put you through even if they were ok with it?thats just my little cherokee opinion.

A shopping center parking lot would be private property. Thus you fall under the rules of the center. At best if you get caught you could be charged with trespassing.

If you must smoke out in the lot, hide downwind. Better yet go home and smoke there.

Better yet, vape. Works great, saves on weed, little smell, better health...what's not to like vs. smoking?

I do it all the time. But i am an activist also. The Cops are called often and i give them my ID and Rec. I continue to smoke or light up another if I finished my first joint. it is the law, you can smoke in your car in the parking lot as long as you obey the 1000 ft rule around schools, etc.

If you're parked, and the keys are out of the ignition then technically you're not operating a car. You're just sitting in a car. :)

As I understand the law, you cannot smoke in a vehicle that is being operated meaning that even if you are a passenger and not driving, you better not light up. In your car w/ the keys in your purse should be fine. I smoke in public all the time. I'm just VERY discreet about it. I usually just take a little walk and find a quiet spot and medicate. Sometimes I even medicate while walking. If a cop wants to mess with you, he can. I was a police officer for 1 1/2 years and trust me, they can mess with anyone, anytime. It was taught in the police academy as "creative report writing". That being said, I have smoked within 200 ft of officers (downwind. DUH!) and haven't had a problem even though one of them saw me do it. I was being as discreet as possible, but you don't ask an asthmatic or diabetic to not take their medicine in public. I don't really see a difference. Be discreet. I also must add that an officers response to you may very well be based upon your appearance as well as general behavior. If you are wearing the stereotypical baggy pants, XXX-LG T-shirt that says "I smoke weed!" or "420!", and acting like a punk then you will be viewed and treated as one. I know a lot of people will say that's profiling, and it is. I learned that I am more likely to find dope, weapons, and stolen property on an individual dressed in this fashion as opposed to the person wearing a decent fitting, un-offensive shirt and pants and not having lines cut into their eyebrows. That's been my experience in the real world.:rasta:

Just don't risk it. Or be ok with the consequences if it doesn't work out the way you thought. I mean its not legal medical where I'm from yet and when I go to the bar for pool leagues I usually bring enough for two bowls. So that inbetween games I can go out and puff one real quick. I know the risk I take when I do this, so therefore I'm prepared if I were to ever get busted.

I suppose you could...but I would be VERY VERY careful. It is usually against the law to be under the influence in a motorized vehicle...even if the keys arn't in the ignition. You may be harassed.

If you decide to medicate in your car...I would suggest sitting in the back seat or something...that way you could argue that you had no intentions of driving under the influence.

I know with alcohol if the keys are even in the car you can still be charged. So I guess if the keys were in the gas cap out of the car she might be able to get away with it.

Under 215, you can medicate anywhere smoking is permitted...except private property still has the Right to make their own rules...but you will not be arrested for smoking--
But in your case, you are parked on Private Property, they can demand you move your car, and as soon as you do, BAM!! You are Driving under the Influence--

I walk down the street smoking all the time. If you have a card you can smoke anywhere you can a cig. Except of course while operating a vehicle.

According to SB 420 disallows marijuana smoking in no smoking zones, within 1,000 feet (300 m) of a school or youth center (except in private residences), on school buses, in a motor vehicle that is being operated, or while operating a boat.

I can't find anything that prohibits you from smoking in your parked car.

vape. vape. vape! the smell doesn't tend to linger from vape as it does from smoke.

I was told by an officer once that if you have the keys even in your pocket or anywhere in arms reach they can hit you with a DUI. He also told me to just put them in the glove box. If you do that you should be fairly safe.

hello. these issues aggravate me. i have been a professional driver for 17 years. i can medicate and drive better than when sober. people have to be their own lawyer every moment. that aggravates me. always splitting hairs with legalese from this medicinal issue reflects badly on authority, and fosters the coolness of being high. i need medicinal so much, and it may never happen for Alabama. the issue is split between in your vehicle- it could be your residence; and if you medicate, this hypothetical entraps you into having to DUI to get home. only the privileged could have their vehicle towed and taxi home. medical cannabis lacks valid DUI testing and permission. people are permitted a driving privilege under prescription medications- why the discrimination against cannabis? work to change the endorsement of cannabis permission while driving through qualified testing. most people would easily qualify for valid cannabis driving.

Well you CAN, there isn't anybody holding a gun to your head telling you no but I would NOT advise it. MAYBE you won't get arrested and MAYBE you won't get a ticket and MAYBE the cops won't harass you but I can 100fuckingpercent gurantee you that IF suspicion is aroused and someone doest call a cop and they don't arrest or ticket you they WILL be sitting down the street waiting for you to drive away then you're busted with a DUI!

I brought some banks of lights to a friends apartment and her tweaker neighbor saw me carry them in, she calls the sheriff to report suspicious activity. Sheriff comes to the door, my friend lets him in and shows him her grow room and documentation, he never asks my name or anything and wishes us a good day! Not a minute later my friend wants to go get something to eat, I was like "uhhhh, he's still sitting in his car in the parking lot, your apt. reeks like weed and you want me to drive off"??

Personally I would find a very, very discrete place to smoke if you have to do it in your car. Flaunting your semi legal rights is not very smart. JMO FWIW

This is the kind of mentality that really annoys me.

Can you tell me what law allows this? You can't walk down the street drinking a can of beer so my logic is that this would apply to cannabis consumption as well.

People trying to flaunt the law are making it harder for everyone.

My advice is keep it at home, if you must travel please be cautious. I've been legal for over a year now and I still treat it as if it's not, I just don't want to bring any attention to myself and/or get caught regardless of the law. It only takes ONE dickheaded cop with an attitude to trump up other charges such as obstruction or loitering, vagrancy etc. I remember once a co worker was busted smoking a joint in her car on lunch in the parking area and it was brought to the attention of management, she wasn't fired but thats a pretty embarassing situation. Just don't be STUPID!
