Medical Merijuana sales info..

Hi,

I got a friends i know online that are growers like me and stay legal like me allways and sales to clubs and to 215 holders only, He puts adds on like forums abd criags list and delivers canubus meds to 215 holders all over the bay.My question is,Is that leagal as i gotto find some ways to sale mine the local clubs up here in humboldt are crap hard to deal with and robbing ya all the time so i gotto find some leagal ways other then the clubs in my area.ate some piot i am hopeing to open a club ourselfs as soon as we can afford the papper word and layer lol but right now i would like to run a delivery only to 215 carries,holders and be abule to bring the meds to there home alot of older people cant allways get out so im just hopeing to do this but i gotto know whats legal and whats not.

most likely legal because hes only selling to other legal people. a cop can probably check him out but he wouldn't be able to do anything other than a federal fine.

though its possible he could get operating without a business license. who knows. I don't think the buyer will get in trouble at all.

Proposition 215 does allow for patients to 'swap' medicine for medicine, and for donations to cover your costs of growing them. What you can do is start a mini collective. I believe above 6 Prescriptions in CA require you to acquire a business license. Now when you have 6 prescriptions, you can grow 'YOUR CITY LIMIT GOES HERE' x 6. Of course you will have extra medicine and instead of destroying it, you would like to cover the overhead of growing your own medicine. Establish a small patient 2 patient list and start very very small. Work your way up from this to paying someone to do your paperwork and open up your club.

Mine opens soon. One thing is, stay legal. No matter what you do, if your prescription is revoked, there is no law stating that it must be given back to you. A prescription is viewed as a 'privilege', not a right. Although, I feel that marijuana is the least of anyone's worries, the law still hasn't caught up to the facts about medical marijuana. This doesn't mean, just go sell because you have your prescription. No, don't ruin it for everyone else because we're all looking for a little chump change. Instead, go about it the right way, read up more, and always, be aware of your rights.

P.S., You are NOT allowed to purchase or sell any marijuana to anyone without a valid prescription. If you don't pay attention to who you sell to, or purchase from, you'll only end up hurting yourself in the end.

Come on, man. "Doctor's recommendation", not "prescription" for cryin out loud. Good luck on the opening of your collective- OR, but it is important you get the terminology right if you want to minimize your problems with the law within the best of your ability.

Remember most places have restrictions on the physical size of the grow too. However, there is a bit of clarification I was hoping for. I haven't seen any mention about if the size limits are for the foot print of the tables/growing/etc and the foliage can over hang, or if all of the grow needs to fit neatly inside the space provided.

I've also never seen anything in regards to height limitations. Just the 10Lx10W.

i love free enterprise. its the American way....now that the state says its ok with a dr's recommendation, everyone wants to get in on the act. i wonder how many people actually get on here and are really legitimate in what they are doing, or are just looking to sell weed.....oh, well, none of my business. im sure the police feed off of these types of forums, checking people out, especially when they have nothing else pressing to do, and nailing those who just want to get into it for financial gain....

FYI bro, ive got a friend who lives in humbolt county who posted selling 420 on craigslist. he got an email, sold to a guy 2-3 times, and on the 4th time, he got nailed BIGTIME. thing is, all of the counties in CA are starting to do their damnest to bust those guys just selling weed under the guise of doing it as "medicine". hes STILL in the county joint over it,first offense. id be real careful about posting shit on there.

if 390 passes, those "collectives" and "co-ops" will be history anyway. prices will level off, and you wont have to go to a "collective" to get your stuff, youll probably be able to buy it at the grocery store and wal-mart.

BTW you will never open up in Cali.. to over run.. you need to move somewhere else.. Ive been trying for the past year and its not easy ... AT ALL!. because of me there are 7 cities that posted up moratoriums.. also i wouldn't try to make any $$ off of "legal sales" ... there's a reason collectives have to be ran as a non-for-profit

also since you can hardly even type i doubt you have the business skills to even know where to start

one problem i see in alot of the "collectives" ( from what ive read, i do my own thing) is they grossly overprice their meds......$45-$75 bucks an 8th is crazy, especially when if you smoke, you most likely KNOW someone who grows if you dont and can get your meds at the going rate. right now, anything over $25-$30 bucks TOPS is really stretching it bigtime;. theres so much tasty stuff going around out there,so many different strains, who pays those high prices?

nothing personal guys, but if you have a collective, and your selling an 1/8th for say, $60 bucks, but yet you can get decent stuff out and about for $20 bucks +/- an eighth, what are you doing but making money?.......ill tell you what, if someone actually opened a "collective" and charged street prices, they couldnt help but take all the business and make money hand over fist. ive had 3 different collectives ask me to grow for them sofar, and have turned each one down. im not the slightest bit interested in making money off of someone else pain and/or problems..

Seem as if more fools worry about my typing skills i leave that to my book keeper and secretary.Senate voted 3 to 4 in favor so anyone will be able to sale.I'm sure they will be provision either way is fine with me and my Humboldt group we do well keeping it legal this just means a more open market..Or the new amsterdam in the usa :) Open a coffie shop insted :P

yea, but whats going to happen to all those $60 an 1/8th sales when everyone can grow it, or buy it at the damn supermarket?.....if something like AB390 does eventually go thru and its legal for whomever to grow,buy,sell,ect.......you can rest assured the days of the dispensaries are numbered. who wants to pay $60+ for an 1/8th they can get down the street for $5.00?



yes, AB390 passed the vote, but he didnt get it done in time to get it handled before todays deadline, so from what i understand, hes let it DROP, in hopes a bill will go thru this november.

actually, it goes beyond that ... you are functionally illiterate, and are under the impression, you're qualified to get rich, supplying dispensaries ... it is NOT legal, to do what you're planning, but don't worry, your lawyer will explain it to you ... :smokin:

you cant explain it to people like that. like i said before, its guys like that that are going to be the death of MMJ.......people who were doing it illegally before 215 was passed, now think becaue they got a recomendation, now its all legal, and it isnt. the guy doesnt seem bright enough to pick up a newspaper, or read or liten to a news story and see people are getting arrested each and every day for exactly what hes openly talking about hes doing, on a daily basis. you hear about this dipensery or that co-op being busted with illegal MJ, phoney recomendations,stacks of cash,ect......all one needs to do is to do a google search and youll see.

whats going to eventually happen is there either going to try to repeal the MMJ laws in ca, or the states going to take it over and open their own shit up. wait and see.........

I agree with ya, this is exactly the sort of 'wannabe entrepreneur' that brings about more enforcement, and dispensary closings ... it also doesn't help, when the very lawyer that wrote Prop.215, says it's all 'bad law' :wtf: ... he was on 60 Minutes one night, explaining how it's such a mess now, and wishes he'd not left the 'dispensary' loophole ... I don't wrap my life around the laws, I've smoked for 45 years, a little late, to sweat it, now :jointsmile: ... but, I always have had a problem with 'greedheads', eager to cash in on what they think is 'easy money' ... the prisons are full of 'easy money businessmen', ya know ;)
