I was reading the new proposal and it says that basically only licensed dispensaries can sell marijuana after March 1, 2010. So I'm wondering how these dispensaries are supposed to get their meds? It would appear that the only legal place for them to get herb would be from their own grow operations OR from other licensed dispensaries.
That sucks because I was hoping to sell my excess to dispensaries after a harvest!
There are ways around almost everything.

What are you thinking to get around it? It said that dispensaries must have proof showing that all of their onsite herb was purchased through legal suppliers.Quote:

But also I'm wondering if this is really the intent of the proposal. I thought Amendment 20 stated that patients can legally sell to each other. So this proposal could mean that only dispensaries that are licensed can sell herb, meaning that unlicensed dispensaries cannot but patients could still supply each other. OR this could mean that licensed dispensaries are THE ONLY places that can legally sell herb at all, meaning patient sales to each other would no longer be legal.
I'm curious on this. Also curious what ways you are thinking to get around this?
I'm only assuming there will be loopholes some lawyer will figure out in the end.
Maybe an individual grower will just get a license as a dispensary entity. I dunno. This shit changes everyday. One politician after another comes up with his own proposal and frankly, I'll be at the public hearings but I'm not going to get too upset about it now. They could be overextending themselves for the sake of negotiation with the MMJ community.
Under the proposal ( I assume you are talking about the Romer proposal) licensed growers can sell to dispensaries, so I'm not sure what you are concerned about unless you cannot or choose not to get licensed, which, given the astronomical costs this regulatory scheme will cause, I wouldn't blame you. I do think it would end small grows' economic viability in a heartbeat though. It would be almost impossible to police where all the medicine that a dispensary has to sell came from, especially when they are allowed to have a grower's license under the proposal. Who's to say what their yield is?Quote:

The provision you're talking about basically just sets March 1 as the deadline for getting a license, and has nothing at all to say about where dispensaries get their product. It also would only apply in the City and County of Denver. If you want to worry, check out Romer's bill. But you are right, at this point it's all yet to be decided. I'm trying (and failing to some extent) not to worry.

What do you mean licensed dispensary? There is no state program to register a dispensary and ammendment 20 does not mention them at all.
THAT is what this post is talking about. The last month or so the city of Denver and the state of Colorado have been looking for ways to "regulate" MMJ. They (of course) are claiming this needs regulation to "protect" the patients, as well as taxing this new industry.Quote:

The amendment says nothing what so ever about dispensaries. They started popping up as soon as Obama said on national TV that the Feds would not persue when state law said it was legal. What does this mean - taken from Romer's Bill? A medical marijuana grower license. A licensed medical marijuana grower must transact all sales using an electronic payment method and must file a monthly report of all sales with both local law enforcement and department of revenue. The location of each grow operation shall be provided to local law enforcement and shall be in a secure facility approved by the local license sponsor. Rules to provide for monthly audits and inspection for all three licenses shall be made by department of revenue.Quote:

What is this local license sponsor approval stuff? Does a dispensary sponsor a grower? Does a grower still have to be a caregiver? Can anyone grow if they meet they the provisions of that definition only? And...how much can a grower grow?
I am not successfully imaging how the grow/supply aspect of all this will clearly be addressed, i.e., if it will be more restrictive or more confusing or more risky or wtf.
They are trying to force growers to create a paper trail so they can't avoid taxes, and presumably try to track where all there product is going, thus the reporting requirements and the electronic payment thing. The local license sponsor is the city in which the grow is located. They are trying to create a two-tiered licensing scheme, and you would have to be licensed by the city before you could even apply for a state license. I don't know about the caregiver requirement vis-a-vis growers under this proposal. I also saw 500 plants mentioned in the proposal as a limit.Quote:

Well, I think the mm community will be well represented in these meetings, and anxiously await what will be hashed out, as they say in the papers.
There is no way they could require a license to grow for yourself. Its a very good thing that Colorado's MMJ law is enshrined in the state constitution instead of just a statute.Quote:
