The Story is from a State where the mmj law has not been passed, unfortunately New Jersey is a State where the Citizens have no say in anything, politicians make all the decisions... "for the people"

A good defense attorney can still get the MMJ in. If nothing else do it at closing arguements.

I just think that a rightful minded person would at least recognize the medicinal purposes of smoking MJ. Even if it isn't necessarily legal in the state, for someone to be using it for OBVIOUS medical reasons, why give them a harsh sentence.

Well the Jury has began deliberating on this one today I believe. During his testimony they still disallowed any talk about medical marijuana or his medical condition. Only thing they let in was he was allowed to say he told the police he wasn't a dealer, but was growing the plants to treat his multiple sclerosis. Well, say a prayer for the man, looks like the going to crucify him.

Bottom line, the judicial system doesn't want the truth to be known, if it was, they would hardly ever get a conviction. Just look at Wall Street, if the truth were know about their activities, we would get numerous convictions of swindlers. Its just the system protecting itself from the truth because it has to continue to live the lie or its life paradigm is shattered. :thumbsup:

Sadly that is exactly the case,reason stated for keeping info about the medical condition and medical marijuana out of the case, they didn't want the Jury feeling sympathy for him... Well.. he has been acquitted of operating a drug-manufacturing facility, the most serious charge that would have been the 20 year jail sentence. Although, found guilty of second-degree manufacturing and third-degree drug possession, so he is facing 10 years in prison..which is by no means acceptable. I think, don't quote me on it, but during the sentencing they may be able to argue the mmj angle and hopefully come up with a better outcome, but still, the charge shouldn't even be on the mans record.Wilson was allowed to remain with his family on bail until his sentencing hearing on February 5, 2010. At such time, supporters hope, The New Jersey Compassionate Use Act could be a law.

Medical marijuana advocates still calling for a pardon for Wilson on the lesser charges, keep those letters going.

Somerville- The trial of New Jersey medical marijuana patient John Ray Wilson has changed dates for the final phase. The sentencing hearing is now scheduled for March 19, 2010, 9:00AM ET at the Somerset County Courthouse.

Wilson, 37 and living with Multiple Sclerosis, remains with family on bail. His attorney James Wronko said this week that the NJ Attorney Generalâ??s Office has continued their request for a seven-year sentence in state prison.

Supporters will continue to rally in front of the courthouse. Now that the New Jersey Compassionate Use Medical Marijuana Act is a law, Wilsonâ??s family and medical marijuana supporters hope the recognition of the therapeutic use of cannabis will allow some leniency.A National Guard helicopter caught Wilson growing 17 cannabis plants used to treat his MS in August 2008. Wilson then faced a nightmarish prosecution on first-degree felony charges usually reserved for kingpin crack dealers.

Citing the medical marijuana legislation in New Jersey, the prosecutor and Judge tried to keep any mention of Johnâ??s MS from the jury. The media then took a strong interest in the case.

Two state senators had appealed to the Governorâ??s Office for an Executive Pardon on the first-degree charges of â??operating and maintaining a CDS manufacturing facility.â?� But the jury acquitted John on those charges. MS patient: Not guilty on most serious marijuana charge

He was however convicted of the second-degree felony of â??manufacturingâ?? marijuana and a third-degree felony for possessing a very small amount of hallucinogenic mushrooms. Thus, he is still facing time in prison.

â??It is stressful,â?� Wilson said during a phone call today. He has seen his sentencing delayed twice in February. The most recent delay stemmed from a "personal emergency" on the aprt of the presiding Judge. John had been preparing for any possible outcome, even finding a temporary home for his cat.

NORML-NJ Attorney Fred DiMaria was hopeful that the Judge would offer some relief to an MS patient, â??There is some discretion on the part of [Judge] Reed, unfortunately John could very well end up in county jail or state prison.â?�
Ed Hannaman, on the Board of Directors at the Coalition for Medical Marijuana New Jersey (CMMNJ) wrote a powerful letter to the Judge:

By growing his own medication, John did not engage in the drug trade and he did not seek to profit in any way- only to ease his suffering. There is no reason a humane civilized society should exact retributive punishment for Johnâ??s act of self-preservation. Notably, the law accepts justification as a defense for seriously inflicting harm on another-even killing them if necessary to protect oneâ??s own life or that of another. How can a system that excuses the killing of another justify imprisoning a person for saving his own life while harming no other?

John is now eligible to become a legally recognized medical marijuana patient. He does not deserve to be sentenced to imprisonment as a drug manufacturer. Passed on January 11, 2010 New Jerseyâ??s medical marijuana law allows only a very limited set of medical conditions for the cannabis program. MS is a qualifying condition. Enactment of the law and full implementation of the program are expected by July or August 2010.

John Ray Wilson, 37, was sentenced to five years by state Superior Court Judge Robert B. Reed in Somerville. A Somerset County jury convicted Wilson at trial on Dec. 17 of second-degree manufacturing of marijuana and third-degree possession of psychedelic psilocybin mushrooms.
Reed sentenced Wilson to five years on the manufacturing charge and three years on the possession charge, with the sentences to be served concurrently.
