Police took my Ounce.

After buying an ounce from H.C.R. i decided to go buy a bong from venice, i get to venice, pull into those small alleys and little did i know i was going the wrong way and 2 police officers pulled me over for going the wrong way, so i open my window and my marijuana was in my back seat in my backpack, the officer asks me if im carrying any marijuana on me because he said it was a REALLY strong smell and i said yes sir i have my medical card, show it to him and he opens my back door and im like woo hey, so i did him the favor and pulled out my ounce from my backpack, he took it then placed me in hand cuffs and gave me a ticket for going the wrong way and for possession of marijuana, he KEPT my medication and now i'm bummed, I'm gonna have to appear in court to get the marijuana charges dropped, but what about my marijuana?? do i get it back??

IMHO bullshit man! Fuck that, they shouldn't of voted to have medical cards if they didn't want patients running around with medicine. I hope you get your weed back in the condition you had it.. They shouldn't of taken it in the first place. Makes me wonder if the police ever give a shit about medical cards or just arrest anyone and have the judge sort it out???

i think thats the case man, cuz he told me to appear in court and talk to the judge..fucking assholes man, i'm trying to get ahold of someone at the court house to see what i can do, called some lawyers for some advice but none of them answered their phones

What you need to do is get a lawyer as well as the doctor whom prescribed the medication and bring them to court and get yourself cleared. Secondly DEMAND your medication back in the condition you had it, which it wont be...itll be older and dry, so instead demand to be reimbursed for the hard earned money you spent on your medication. Would a LEO take oxycontin from an old man if he saw the pill bottle in the car, i think not. Why do they take away medication from legit users with a legal license to use it, its the SAME THING. Oxycontin is illegal for non prescribed users to carry around just like MJ and you need a prescription for both to be legal. Most LEO are uneducated about MMJ and the laws surrounding it so they get scared, ticket you, and make you go trough this whole unnecessary process. Its our job as patients to educate them on our rights as Americans and card holders. Don't let them push you around if it ever happens again, let them know you have the law on YOUR SIDE and that you are prepared to take them to court for basically stealing your medication.

heres the thing with the law with mmj, the state gov in cali is chill with it, totally legal. BUT the Federal government is not.. and techniqually they got more power cuz they are like the USA government rather than the California government. The law says that the RX bag has still got to be stapled, un opened, and concealed (i think the trunk but idk) until u get home and it is to stay at your house.... that is the law =/... you come across asshole cops like that one, they can pretty much do whatever they want unless its in your trunk, because it is against federal law, but the victim will probably get cleared in court.... Other cops on the other hand will go out of there way to protect it because it is legal in state law. like there was a police station that stood outside a dispensery that was about to get raided by feds a few years back and they ended up protecting the club from being shut down. ive also seen and heard cops giving people (minors included) herbals/pieces back with no ticket. still though most cops are faggot fucking pigs that need to be shot execution style, but there are some tight ones. so yea thats pretty much how it is... My friend got pulled over for speeding with a Pringles Potato Chip can full of skunk....The cops took it.... gave him a ticket for speeding, sent him on his way.

I was in a similar situation as well a few days ago, but it was only 4 grams: 2 G.D.P. and 2 Bubba Kush. :mad: Even though I told them that I am a registered patient and that I did have my meds in my car, they still put me in the back of their squad car and searched my vehicle without asking permission. I give them a small, wallet-sized copy of my doctor's recommendation so that they may verify it and one of them tells me that it isn't valid within Riverside County. :wtf: I'm guessing these guys were either rookies or just didn't know anything about the medical marijuana laws since they had a third officer show up a few minutes later, had a brief conversation with him and then he just left...
They didn't even state the reason for pulling me over; they just handed me a notice to appear in court for a traffic violation (no traffic violation stated, just possession of marijuana) and let me go about my business. It somewhat feels like a case of unjustified narcotics profiling to me. Any advice?

Sad but true...cops don't need warrants for shit. Despite all of our supposed rights and liberties, state and federal agents/public servants have their own counteraction hand book so to speak. "loop holes" On a whim even a beat cop can kick your door down whenever he wants to. He just has to find something when he does. All he has to do is make one of many statement options he has such as "I approached a subject on foot for questioning at _ street, the sub proceeded to flee towards (your adress). As I rounded E side of said adress I lost visual of sub. I then heard a female scream within said residence, I then made entry to find no sub but did find......They have even more renditions of this for traffic stops...I smell the strong odor of...I saw your passenger holding up a....or the most widely used...do you mind if I search your car?...no..ok, hold tight while I get K9 here. Acutally that is only partially correct. The federal government is not the supreme ruler of the states. The states are sovereign and the federal government's job is supposed to be to resolve issues between the states, not to tell them how to run themselves. The supreme court stated that federal drug laws DO NOT preempt state medical marijuana laws. This means that the state law is NOT superseded by federal drug law. If you would like to read more about this click here. State employees (sheriffs, state cops, DA's etc) must uphold state law as they have sworn to do when they are put in office. They do not have the authority to prosecute someone based on federal law. That's why they call in the feds to raid the clinics they want to shut down. If that clinic were really breaking state law the local LEO would have the authority to shut it down themselves and prosecute the people who owned and operated it.

Please show me the law you are referring to. I know of no such state law in California. As a matter of fact under California state law you can roll up a joint and smoke it anywhere that 1)smoking isn't prohibited by law or that isn't 2) within 1000 ft near a school, recreation center or youth center (unless inside a residence) 3)on a school bus 4)While in a motor vehicle that is being operated; and 5)While operating a boat. As far as I am aware you can eat it anywhere. I know of no state law that limits where you can posses Cannabis in California only the quantity you may posses. The state quantity laws can only be increased by local county and city ordinances. Any ordinance that restricts possession amounts to below state levels is not valid according to SB 420.

This was addressed above. State and local cops do not have the authority to enforce federal laws, period. While MMJ is illegal on a federal level there are far less federal LEO than state. If it were not for local LEO calling in the feds there would be far less federal prosecutions. Right now the fed is only going after people who stretch the law to its limits and those who are vocal and active politically trying to change federal drug laws. The DEA is currently using the law against political opposition. I believe there is (or was) a lawsuit filed by WAMM or ASA about their selectively targeting people based on their political activities. It is my opinion that state LEO do not have the right to use federal LEO to do the job of prosecuting law abiding citizens. If they cannot arrest or prosecute someone then they should not have the option of calling in the feds to do so. They should in no way cooperate with federal LEO to prosecute any law abiding citizen and should be charged with a crime for doing so.

As they should when they are enforcing and upholding state laws. Which is their job. Of course you will find cops do what they think is appropriate and let the courts sort it out. Another reason to have clear rules regarding MMJ is to keep people out of the already overtaxed justice system.

I think that's a bit extreme and not really a productive attitude to have. There is a war on drugs and how can you not want to fight back. :thumbsup: I just think there are more productive ways to fight against the war. But I understand your frustration about the abuse of power of a significant number of LEO. Not to mention the abuse of power of the DA's, judges, and other elected and appointed government officials including the governors, congress, and president.

As for the original post, I'm sorry to hear that the local LEO are still not doing their job properly. The state is working to make it easier to legitimize mmj use but as long as LEO use their discretion people will still have to go to court to assert their rights. You should have never said you had it in the first place. I know it seems like the right thing to do but you need to assert your rights. It's your tax dollars they earn anyway make them work for them. ;) Hope the courts give you justice so you can take your meds and get :stoned:

It isn't the law but it is a good idea considering the fact that many in law enforcement don't seem to respect or understand the law.

There is precedent for getting your medicine back, so if you have the time and patience, take it through the courts. ;)

I do not understand why people feel it necessary to volunteer this kind of information. I would tell them NOTHING. The only thing I would ask is why am I being pulled over, accept a traffic ticket. if the cop tried to keep me, I'd ask if I'm being detained, if yes, why.

If no, have a nice day. You can't expect these jerks to follow THIS law, they can't follow half of the other laws on the books...why should this be any different?


Patients need to educate themselves about how to deal with the cops BEFORE this happens, not after...

BTW they didn't need a search warrant at that point-by telling them you had your meds-what THEY consider to be illegal in most cases-you gave them probable cause. You can fight to get your meds back---as was posted above, but don't give the cops ammo to use against you in the first place! You only got a possession ticket, but now you have to go through all of this pain in the arse stuff...

And yes, go to court. Let the judge sort it out.

Realize that oftentimes we are our own worst enemies when dealing with the cops. Maybe I shouldn't say "we" when I mean the uninformed among us. But of course when you're in the company of such uninformed individuals, they can sure cause the rest of us a lot of unnecessary trouble.
