The court overturned a ruling by the Louisiana Supreme Court, which had held that child rape is unique in the harm it inflicts not just upon the victim but on society and that, short of first-degree murder, no crime is more deserving of the death penalty.

Justice Kennedy, while in no way minimizing the heinous nature of child rape, wrote that executing someone for that crime, assuming that the victim was not killed, violates the Eighth Amendmentâ??s ban on cruel and unusual punishment, which draws it meaning from â??the evolving standards of decency that mark the progress of a maturing society.â?�

Because I remember a very public case of that 17yo kid that was sentenced to 10 years in prison for getting a blowjob from a 15yo girl. He had it overturned and was released after 2 years in prison.

I wasn't avoiding the issue at all, I don't believe either of us can change the others mind. I am very against the death penalty for personal and spiritual reasons. You are obviously staunchly for the death penalty. These are facts that neither of us are going to change.

I find it funny that conservatives, the supposedly "Christian" of the two labels, are in such a hurry to execute people, while it is the "godless liberals" that are against executions and guns, and are for universal health care and programs for the less fortunate. It is overzealous people like you that give Conservatives the bad name they have now (I'm a moderate/liberal myself). I personally don't mind the death penalty too much, but I respect the people that do.

When I have children one of these days, the last thing some son of a bitch will need to worry about if he does ANYTHING to my children is what the court is going to be able to do to him; he'll be dead.

No death penalty for child rapists? Ok fine just put em in general population down at the prison and let nature take its course. Seriously thats just as good as dead. The policy should be that these people get no special treatment, if you rape a child then you go to prison just like if you killed someone or robbed a bank. Yeah you're gonna get repeatedly prison raped, but hey so do some of the people who just wanted a free car or to sell some weed.
As for the death penalty, I think the people who want the perp dead should have to put them down. If your child was raped and you want the person who did it killed then after the trial and all that instead of some anonymous individual throwing the switch it should be you. Never ask someone else to do something that you arent prepared to do yourself.
And just in case anyone is wondering, yes I would be prepared to do this myself (just in case that even needed stating) I don't think we should play fast and loose with the death penalty, if you're gonna take someone elses life you better be damn sure they deserve it first. Of course that brings up a whole bunch of other issues like: "can we ever really be sure?"

The problem with child rape, in most case's; The child doesn't remember the offender and often the crime itself. That is how the mind protects us in some meaninful ways. From my history of trauma and pain, I prefer not to remember. I feel no punishment is enough for this type of crime against, America's prized political power of tomorrow; the small, unprotected citizens of our fine country! That is our job, protect those children. I think there has to be enough DNA data or specifically the kid rmembering the person and that person's memory be evailuated for correctness every 5 years! Sometimes, women have remembered incorrectly and unable to live with themself after sending someone to jail for decades when it was in fact, another person that looked almost alike the person that did the crime. so, some case's need to be open, and defendant held until proven guilty beyond a doubt. Or, I think most admit, make the punishment for the ?crime be so high, people do not want the punishment. Fist time? Take off one nutMacadamia and apricot nuts)! 2nd, the Second nut; Third: keep on going. And no re-constructive surgery. Easier to find a rapist with one nut or ovary than 2!:hippy:

I have seen this in my own family. Always felt, my niece had infant child abuse behavior. Had a step-father or two or 3, etc. Anyway, it ended up I was telling one of 4 brothers of mine and he said he abused her. "But, she was so little how could she remember?"
I told him her mind never forgot because her behavior has lived like a survivor!

These people know what they have done to ruin a kid from living up to their potential, instead a life of mental anguish! I could go on. But, when you are 'of age' You represent the generation that needs to set a good example-are you living in the home of your dreams (and wondering how to pay 4 it), as opposed to how you don't want to live!

I don't lust for blood itâ??s simply a very realistic point of view. It is for the greater good of the whole social order and would make paedophiles think twice. Those who commit heinous crimes don't deserve any mercy, we owe that to those who have had their lives destroyed by these perverts.

The great thing about being human is that there is so much variety. Naturally we're all going to have different opinions. Personally I agree with previous posters in that I do believe in the death penalty for child rapists but I think the court also needs to apply common sense in certain cases. Something we seem to lack in this country lately. :hippy:

The problem with the death penalty for a nonmurder crime is where do you stop? Once you open that door they'll be screaming for the death penalty doing drugs. You can't allow the government too much power. We've all seen what happens.

I agree with this however at the same time I don't appreciate my tax dollars going to support these scummy people. Statistically many offenders are repeat offenders as well. Which goes to show that putting them in an institution such as prison has not been working.

Personally I'm perfectly happy with giving up my rights to rape children. </sarcasm>

I'm will not happily give up my rights originally granted to me by my forefathers however. (not sarcasm).

Again the law needs to be interpreted using some common sense. If only we had some common sense amendment that could be forced on our judicial system.

I didn't mean to imply anyone was anything, I only meant that Some people believe all death is wrong, and that doesn't automaticlly make anyone anything.

I used to know a psychotherapist that worked with sex offenders (she wasn't my therapist, before anyone asks, lol), and in all her career (like 30 years), she only had one repeat offender. Sure it doesn't help the victim in that one case, but they are able to be rehabilitated, the same as any other criminal (even though they are the worst of the worst). I'm not saying this makes anything ok, nor do I approve of taking it easy on them (I would'nt have been upset if the Supreme Court had ruled the other way), I'm just throwing it out there.

Honestly, I think they should have really bad stuff happen to these people, but lets lock em up and throw away the key. We can start releasing cannabis offender to make room for em ;)

I agree. The prison members will do such a better job of punishment than any lethal injection could. Lots of pedophiles in prison end up dead one way or another, and it wasnt so easy as getting a needle...I think that may be punishment enough.
I am pretty split on the death penalty issue. On one hand, for sex crimes against kids, or brutal murders, like serial killing - i am for the death penalty. On the other hand, it kind of seems like the easy way out, no? Personally I think it would be best if they sat on death row for like 20 years...just waiting and thinking that they were gonna die. That will fuck with someone's mind. But then you have to fund for him to keep the steel bench warm...which defeats the purpose.
But if they only have to wait a few months and are then put out of their misery, how does that bring any sort of good to the situation. Sure, he is off the street and can't harm people, and the family rests better knowing that the man is dead and won't do what he did again...but will it fix that child? mentally? physically? probably not. He/she will need extensive therapy, for many aspects of life can trigger mental recollections...or even a later romantic encounter can be unpleasant, because it also triggers thoughts.

We need to stop worrying about the offender so much, and think of the child. What measures are we adjusting to ensure the best recovery of a child who's been traumatized like this??? I say stop worrying so much about what happens to the sicko, and start worrying about helping the child. Lots of times the child grows up to have a lot of problems...the best thing we could do is ensure he/she gets to lead as normal a life as possible, so at least the sick fuck didn't take that away from them too.

Parents need to be dilligent. Pedophiles haven't changed from the way they've been since the beginning of time. People just need to kepp a watchful eye over the rug rats. I'm not infavour of our government doing parenting for me.
