Something I've thought about while stoned

Suppose you and your friends were driving around town and had 2 or 3 grams of weed on you. The cops seeing you passing a joint when you drive by, so they flash their lights and pull you over.

Now, what if you pull over and just locked your doors and windows, took out all your weed, and you and your friends just power-toked it as fast and hard as possible. You smoke all of it up in bowls so there's not even a roach left, then unlock the door and say "yes officer is there a problem?".

Could they still charge you with posession now that all you posessed is up in smoke?

(note: They could get you on paraphenelia charges for the resin in the pipes, and maybe something around the lines of resisting arrest).

At a party i was at, there was a riot, and the police were chasing people to their cars, and they smashed the windscreen of one car and pulled the dudes out of the windows and started hitting them. Yeah, so they could charge you with DUI. I'm asking if they could charge you with posession, after you smoked it up right in front of them with the door locked.

Down here in the states, posession is a slap on the wrist compared to a DUI. If he can give you a dui, its not even worth his time to write up another ticket for posession. So you'd probably get out of it that way.

*sigh* dude, I'm not being clear enough it seems. I'm not advocating this as an escape method, I'm just saying could they hold this particular charge? Because they did catch you with it, they just don't have it.

I was busted once with marijuana, me and my buddy were in a car, parked next to his house. (I know stupid idea, but we were young and his parents wouldnt let us smoke inside or on the porch) Anyways the cop catches us in the middle of a blunt and since i already had a sack full of herb in my pocket I took the blame for all the weed. But when they searched my buddy they found a pipe on him, which had less than a bowl in it. So i got Possession and he got Paraphenilia and Possesion for less than a .5 probably! So IMO, and based on my experience, Yea they would get you for that, atleast in America.

hmm, in that case, im not sure GtG... if they could prove that you had JUST smoked it, they might have a case, but probably not

id say no. although i dont think itd be possible to burn through all the weed in that short amount of time, there is no law against smelling like weed, and how can they charge you with posession of something you arent in posession of.

First, any professional peace officer is going to come through that window and stop the smoking plan in short time. In my town, theyd have the SWAT team do that. You would then be charged with possession for sure because they'd have what you hadn't yet smoked.

But any police department or DA worth its salt isn't going to be as worried about the possession charge as it would be about the worse offense, which would be evading police and resisting apprehension and arrest. They'd then add on the concomitant possession charge to lengthen your sentence. You'd have higher bail, pay higher fines and be sentenced to longer time served/probation.

All they have to do is smell it on you or in the car and they can charge you with possession. Ironic that they can do that with out evidence.

Not sure what start you live in, Bogart, but you need to read about what constitutes possession there. In all the states I know of, a possession charge requires evidence of possession, that is, the weed confiscated, weighed and measured and logged in as evidence. Evidence of prior use through smell is used a lot as probable cause to search, but it doesn't constitute possession.

Gandalf, it depends on the state. I got charged with a misdemeanor (this case is pending) in Maine where pot is decriminalized. You can possess, I think it's up to 2 and a half ounces (it used to be 1 and a 1/4), and it is only a civil violation. But I got charged with "furnishing" which is passing a joint. It was a roach, actually, which they did not even collect for evidence. These undercover cops saw me do it.

EDIT: From what I have read of the law, I am not guilty of furnishing because the amount I possessed was not criminal. In other words, unless you give someone a 3 oz. bag of weed, or are passing a 3 oz. joint :D, you cannot be convicted of furnishing. I am still trying to get a lawyer, and fight this.

Damn cops.....i know they are just doing their jobs but its all bullshit!
