But yes, I believe that you must identify yourself to a police officer if he insists - even if you did nothing wrong.

Actually the supreme court ruled at least a year ago that you are required to give them your name even if you did nothing wrong and if you don't trust me if they decide to charge you with obstructing or something similar they can make it stick I know they can in NY bc me and my buddies were just hanging out and the cops questioned us and my one friend didn't give his name just to be an ass and they charged him and it did stick it was a nothing charge but he had a much worse night then we did lolQuote:

I didn't think you had to, does anybody have any links to prove you do have to give them your information if you aren't being arrested? This little card I got from ASA says to ask them if you are being detained, and if not, simply walk away. I'm guessing maybe they can charge you if you are a prick about it and stick around, but how can they arrest if you they tell you you aren't being arrested, and you walk away?

I think it depends on the circumstance. If the cop is asking you because he is investigating a situation, then I think you have to. However, if you are just walking down the street with a "Legalize Marijuana" T-shirt and he asks you, and tells you you aren't being arrested, you should be able to walk away. I mean, if you ask if you're being arrested and he says no, then he can't arrest you for walking away right?
I think most people that get in trouble probably do something to instigate the officer, anytime you are dealing with police common sense should be used. It's like when you see videos of guys screaming at a cop "FREE SPEECH FREE SPEECH", and then he gets arrested. From his view he was arrested for nothing, but to others it's obvious he was creating a situation. Walking away isn't creating a situation.
Yeah im just speaking from experience. I was just walking at a movie theater and these fuckin dicks came at me for my id. I gave them my id and they said I was lieing threw me on the car and searched me. Then they put me in the backseat and said were taking you to jail unless you can prove you are the person on the id. They said the id was not coming up in their database which is bullshit they just thought I possibly stole it. Luckily my brother was in the movies. I told them to call him ( they took my phone) and my bro cleared everything up.
So yeah I would think they can ask for your name.

Trust me. Fork over the information honestly(avoiding 6mos for falsification and/or obstructing official police business not including a hefty fine). If you've done nothing wrong then you definitely have nothing to fear. Show credentials upon request and expedite the situation as such. Nowadays they're allowing undocumented(criminals)imbeciles to run around rampant with guns and badges so watch you're every move. I know from blood, sweat and tears.

Yeah... in the US, if you don't provide your name and ID, they'll definately haul you away and put you in a cell until you change your mind, or they identify you. Anyways, there's no reason not to tell the police your name, its not like they're going to find out in the long run. Be smart.
