SACRAMENTO, Calif. -- The taxman is going after the medical marijuana man.The state Board of Equalization is telling the estimated 150 to 200 medical marijuana retailers in California to pay sales taxes on pot.The 1996 initiative that decriminalized use of marijuana for medical purposes did not address how state tax officials should deal with medical marijuana sales. The sales weren't covered before Proposition 215 because they were illegal. [align=center]

The board ultimately decided that medical marijuana was not exempt from sales taxes because it was not dispensed by a pharmacist or approved by the Food and Drug Administration as a medication.The board's action has divided the medical marijuana community, with some sellers saying it helps legitimize their businesses. But others worry that any tax information they report will be used against them by the federal government, which still bars use of medical marijuana.

make the dispensaries pay the tax on it. Their suppliers are selling it for 4k a lb..that's $250 an ounce. They're selling it anywhere from $80-$150 for 3.5 GRAMS. tax the fuck out of them, and give some support to schools and state governments.

What the fuck! if they start taxing medical marijuana then busts from Fed's should totally be out. Paying money to be shut down is fuckin stupid if you ask me. If they are gonna tax this thing then Govt better make it just as legal and safe for medical patients to be able to obtain and use medical marijuana like they could obtain and use those pharmacy pills and stuff.

It does buy you protection on the state level in California, I guess because its the state doing the taxation. Unfortunately it's not the ffeds saying pay up and we'll leave you alone.

By taxing the dispensarys,they are admiting guilt of possesion,and distrubution which are both protected by the 5th amendment. If the government wether state or federal wants the tax money they need to legalize it and tax it correctly. Taking money from someone for doing something against the law..........seems alot like in Goodfellas when they gave the godfather Paulie money for doing nothing but being the godfather.

yes, i think this is good in a roundabout way; taxing makes it more legal, more acceptable; this is good for future efforts

well for as long as i can rember there's been 2 constant things in the U S death and taxes everyone must pay taxes and everyones going to die no if ands or buts about it so why fight it as it will just make it harder to get other states to legalize it if the medi deals don't step up and operate by the laws

sound like price gouging to me as if they are charging 150 buck for an eighth after 2 eighths they have the rest of the once is nothing but profit yes they should pay taxes with a mark-up like that and help get it legalized in other states as well and they will still make money as at 150 an eighth they are making 19,200 buck a pound and only paying 4 grand for it hell maybe i ought to move to Cali and get a med pot dealers license hell i'd be a millionair in less than a year
