One of my friends the other night..
Got pulled over and given a ticket for paraphernalia and cds marijuana...there's a twist to this though...the officer was outside of his jurisdiction and finally when they did manage to find the stuff, they called an off duty county officer who was wearing plain clothes and had no badge on him, he wrote the tickets. Not to mention he had to wait like 15 minutes for the bastard to get there..
The cop even told my friend that "that curb over there is where my jurisdiction ends, so I'm gonna call someone else to write these tickets"
Is it legal for the cop to pull him over where he has no jurisdiction, search his truck and then call someone who does have jurisdiction write the tickets up? There was no initial reason for him being pulled over, he wasn't high, so there was no fucking reason for the cops to search him for drugs..am I right or not?
I know, I know..this should be in legal, but general gets more activity so if you could please leave it here for at least a little bit? thanks, and thanks to anyone who can clarify this a bit for me..:thumbsup:

I have no idea...I wasn't there, but no he wasn't speeding..and he was probably scared..
and the amount of weed we're talking about is about a bowl that they found...not much at all

A cop is a cop 24/7 whether they are being paid or not. They can stop someone out of their juridiction and hold them until someone from that jurisdiction can actually arrest them. I am not sure about searching though. If he was stopped by a cop in that jurisdiction, Carroll v. US would apply (Google it). I don't know what your friend did to get pulled over but he must have done something. Is he telling you the whole story?
Holding him for 15 minutes would be considered reasonable time to investigate by most judges.
Now, just because you want extra attention doesn't make it right to post in the wrong forum. Yeah you got extra attention but was any of it really answering your question till I said something? :jointsmile:

there was no reason for the search....he wasn't high or they would've mentioned that...there's really no reason for them to have searched his vehicle, right? and beyond that, he had to wait while they rummaged through his truck..keeping him for more time there..
did they violate his 4th amendment by doing that search? they basically said to get out and we're going to search your vehicle..

cops are dicks they like to intimadate you and confuse you with double questions most people dont know there rights and cops just feed on that and try to confuse you as much as possible and before you know it you consented to a search.you should never trust a cop they cant help you there only trying to get you to admit your wrong doing.never consent to a search even if you have nothing to hide,ask questions,what laws you broke,ask for a supervisor,show that your not some idiot that will buy in to there bull shit.
