He said he is out of state right now. No one has mentioned "interstate flight to avoid prosecution". Getting some legal help, and having them contact the police asap seems to be a good thing to do.
Let's be real here, unless you get a judge with a soft side (in TX? Really?) you will not be able to pass the illegal entry mess off in court. The complex's way of notifying you is by putting notes on your door. Is that not what they do when they come in to change air filters, pest control, etc...? No complex I have ever lived in has ever called me to let me know they were coming in to check anything and if it's been an emergency because of a leak in another apartment, there is no notice, they are coming in regardless. They are there for the upkeep of the property and don't really give a damn about your privacy. Either get to know your maint. men to get a feel for them or don't grow in someone else's house. If you have never been charged with anything before and you have a lawyer, you will probably be able to get probation. I kind of think it really all depends on your judge and how they feel about drug charges. Were you charged with a felony or misdemeanor charge? Were there any other charges other than possession, like intent to distribute? Friends I've had on felony probation have gotten 10 yrs for various charges, not necessarily all drug related. Best of luck to you and I hope you get something as easy as possible to deal with.
So, I'm not off of probation until August 28th, but my last piss test was on July 14th. Woo. Thanks again to everyone who gave me pointers on what to do, everything kind of worked out in a decent manner. I even learned an important lesson: don't leave a refrigerator-sized grow box in the bedroom of your apartment, let alone for an extended period of time unattended hahaha. Well, I hope everyone else is having a lot better luck than I did.
wow man, I'm surprised you got off so easy. My buddy got busted in a similar situation and since there were "roots" they busted him for >lb and is in felony prison right now. Your lawyer did well. And congratulations man. now GTFO of Texas. This state sucks for people like us.
I'm gonna have to agree with this one. Step one, stay away from the phone and do not speak with the police. They will attempt you to confess to ownership of the plants and tell you it's no big deal. Texas treats this very seriously right now and they don't care how tall your plant was. They count pots only. I would force them to make their case without your cooperation. They had no warrant and the discovery was made outside your presence and control for that matter. Who's to say the maintenance man didn't plant those things there fully knowing you were not in town. How many times have you had confrontations with the apartment complex over shoty maintenance and the such? Who's to say they didn't finally have enough of your complaining and set you up.Quote:

Personally, if I knew I was going to be arrested for growing pot in Texas, I would never return. I would hire a lawyer to represent me in Tx and attempt to resolve the matter without my presence. If the day comes when they ask you to return, you will have to make the choice to either come home and take it in the ass (which you will) or begin a new life somewhere where they wont bother you.

I watched a cops episode where a 16 man task force raided a drug house in Tenn. They confiscated approximately 1/2 oz of super Mexiweed, about 40 dollars cash money, and a ledger of debt totaling approximately 220 dollars. Give me a fucking break Tenn. Talk about state hostilities. I laughed mostly but it made me think of the hypocrisy each state has towards this issue.
