If a 5 year old kills their little brother because he steals his toy and the 5 year old doesn't grasp the concept of death? In my opinion - ABSO-FUCKING-LUTELY NOT~! There are different levels of down syndrome, those with evaluated mentality below that of the average 18 year old should be permenantly regarded as minors in regards to the law.

I totally agree with that.The law should be the same for everyone even if they are retarded.Too many mentally unstable people get off with things such as rapes and murders and they just get sent to a mental hospital rather than paying for thier crime and going to jail.

mental hospital for the rest of your life, or jail for the rest of your life... whats the difference? the only difference is that mental hospitals are equipped to deal with mentally handicapped people.

ok, if u do a crime u should get punished, it doesnt matter who u r or what circumstances ( disability, mental illnis ) a person with down syndrome shouldnt b sent free if that person with down syndrome killed someone else. u can argue that they have no understanding, but they r a crimanal if they did the crime.

and btw, say for ex. a mentally challenged person is givin a qaurter of weed by sumone he knows. that person ditched the quarter b/c cops were searching him. the cops then search the person whos mentally challenged. they find the quarter. and ur gonna argue that he had clue what was going on but here he is breaking the law by holding that quarter. no matter what circumstances, he did a crime, and therefore should b punished.

( and btw, that was purely an example )

and we can all hopefully agree on that a life sentence in prison for a healthy person is the same as a life sentence in a mental hospital for sumone whos mentally challenged

Ive been there ghost they are nothing the same as jail even in a maximum security mental hospital here.

The diff is they arent as supervised and the innocent people that are in there for things such as depression or bipolar schizos whatever arent protected from serial rapists that are put in there believe me i know cause i had a serial rapist break into my room with a knife in the middle of the night while i was there.There was supposed to be security in the corridor outside my room.I know it happens in jail too but it just aint that easy to break into another persons cell.Anyways i met rapists and murderers in there and believe me they should be in prison getting done to them what they do to others.
