Federal Judge Strikes Down Obamacare Mandate

Hudson sided with Virginia Attorney General Kenneth Cuccinelli, who argued the mandate overstepped the bounds of the Constitution.
"The ruling is extremely positive for anyone who believes in the system of Federalism created by our founding fathers," Cuccinelli said. "It underscores that the Constitution's limitations on federal power really do mean something."

The terrible tragedy in Arizona has postponed the repeal vote.......and rightfully so. Prayers for all killed and injured.

How about this? If you don't want to buy health insurance (even though if you're poor it it's payed for) you don't have to. But if you get in a car wreck, sorry better have cash or you set on the sidewalk outside the emergency room and bleed to death. Why should you be able to not pay, then expect to get treated anyway? You got greedy, gambled, lost. One could argue your removal from the gene pool serves the common good. But given the whole country to shop for judges you can find one to rule anything you want. It will be overturned on appeal and everyone knows it.

Looks like the Virginia Supreme Court is not alone in striking down the ObamaCare mandate. The Florida Supreme Court has now followed suit:
Florida Judge Rules Obamacare to be Unconstitutional - On to Supreme Court? | Texas GOP Vote
And 26 other states have entered the fray. Hopefully, they will strike down the mandate as well.

I like to think that we can follow the constitution and yet still remain compassionate. I would not be for allowing someone to bleed to death in sight of a hospital... that would just be wrong. Not just that, but what about the unconscious victim who shows up with no proof of insurance? I do think though that after stabilizing someone, it is time to start looking at who is going to pay. If they can't pay... then they shouldn't get more than basic services. I'm sorry... Darwin had it right.

I also think that it will be declared unconstitutional and my bet is 6-3. I think a couple of the justices are going to have quite a hard time with this. :stupid:It is going to be a good show and I am here for the ride!

^ yeah, me too, this is interesting to watch irrespective of how you may feel about the health care issue. to me, its just interesting to watch the machinery in action, seeing if it works, to see if the Constitution is still the law of the land and its built in limits of the federal gov't are upheld.
for those keeping score at home  its two judges overturning it and two judges ruling its okay. definitely going to the supremes, O'Reilly is predicting 5 to 4 vote to overturn it.
