It was never ruled unconstitutional. CDPHE tried implementing a 5 patient limit and it was challenged in court. The judge ruled that CDPHE didnt follow proper procedure when they added the rule by not holding a public hearing first. CDPHE then held a very long hearing and afterwards voted to not implement the plan. I do think it would be ruled unconstitutional if it ever got to that point but it hasnt yet.Quote:

I believe their are several areas that are unconstitutional. So I believe there is a very good chance this will go to the courts and will be overturned. Another strategy is for everyone to lobby Gov. Bill Ritter to veto this bill if it passes. He is not running for re-election so he really has nothing to win or loose politically. And if we all get screwed?
