Here's something to wonder about...How can the cops use a bong of pipe for probable cause, when it isn't clearly given whether it's a tobacco pipe, or if it's been used for smoking marijuana, if they don't smell or see marijuana, that alone should be probable cause..but I donno, it probably doesn't matter..
i dont think your telling the whole story.
Will the cops try saying that they smell weed just to obtain legal entry to your house/car and search it regardless if they smelled it or not?

The cops are sniffing for a trail back to a supplier. Your bro had bought recently, I am sure, and they tailed him to your place. They may have been trying to estimate as to whether or not he was dealing.
i hung with a 'rough crowd' in high school but was always known as 'the good guy'. we were in a band and used to practice at this one dude's house who had a reputation. one day his buddy shows up with a car TRUNK full of weed. he bought, a few bought (I was broke and had a bad 'vibe' about all of it).
a few days later coming back from band practice i got stopped walking. the cop, who knew my family, stopped me and told me to steer clear as they were watching that house and sizing up for a suspected raid, and trying to sniff back to a dealer. he told me this as if I were there when it went down I'd be going away too, and he trusted me to keep my mouth shut. Which I did except to tell my friend that I "knew" the house was being watched. In the next few weeks this cop told me, "I'm not looking for you or your buddies smoking up - we're trying to grab a supplier/dealer. We don't care if you sit around your house and smoke pot."
Will the cops lie and say the smelled weed? Did GW Bush lie and say that there was evidence of Weapons of Mass Destruction? What do you think?

Is just a bong enough for probable cause? Because bongs can be used for anything, its only drug para. when there is residue in it or something.
I also agree that you may have consented to allowing them to enter without knowing, however I do think that with a lawyer you do have a really good chance of having the charges dropped.
No. I have been through the exact same situation. Exept the cops were at my neighbours house and when i stepped out to see what was going on and argue in defence of my neighbour, one officer came to my front door and saw my bong that was clearly visible. Long story short he ended up taking it (no marijuana in the house). I took him to court and i won the case. I live in Ontario, Canada so i dont know what the laws are for other places of the world but i had the option to actually sue the officer to trespassing without a warrent. But i didn't. So i urge you to fight this case. You will win.
You shouldn't have let them in your house without a warrant.
All the cops have got to say in court is that you let them in to the house to discuss a traffic violation, they smelt cannabis and saw a big fat bong, and that gave them the grounds to start pulling the place apart for drugs.
I've been trying to teach my mom this week (the police came to her house looking for me and she just let them in to have a poke around) - I've told her... "THEY DON'T COME PAST THE PORCH WITHOUT A WARRANT".
You messed up - it sounds like you let them in in the first place, if not, then al they have to say in the report is that you let them in enough for them to see a young guy with a bong. They will lie and say that they could smell drugs - even if they couldn't.

I don't think that a bong on it's own is probable cause in a court of law. You have to put it in context. If the Police are investigating a theft in a big old rich house and they are speaking to some old guy in a suit, when they come across an ornamental gold bong, then I doubt that anything will ever happen...Quote:
