Don't worry man you'll still be able to be compensated for your efforts. You don't have to just donate your time!! You can charge an hourly rate for your caregiving services... At this point I don't think the government has told us what a reasonable hourly fee would be for caregiving services ("tending to plants").... so you can set whatever you want and make the exact same amount of money you did before by working the equation backwords (Time x Rate = $$$). Obviously, you'll also be passing on the cost of electricity/supplies/etc onto your patients as well in order to cover expenses... so your hourly rate will be your compensation.

exactly which if it stays like that it will be fine on the low side but the "middleclass"so to speak will be wiped out.and just think of how we will have to dance around dry usable weight.this will somewhat put the wrench in the cog. as most patients only need a couple oz's a month far from what you will have come harvest.so now instead of being able to off load the rest to keep on trucking you will have to keep most of the plants alive until all is gone which will hold things up.i guess it's ok for some but for those pulling close to an lb per plant it will be a back up.
humm just a thought but this is where we as a whole as small caregivers and patients should ban together so we can network amongest ourselfs to off load extras to each other as needed and to keep the vast amount of diffrent strains available to each other? this could bring us closer if they don't try to push more laws on it to push us even further away from each other.

This is correct, Romer was saying that all state licensing apps need to be in by the 15th of June and the ban starts on the 1st of July and the actual law it self will begin the 1st of July 2011, disp. must have the app in by the 15th of June 2010 or they will not get approved.

Corry was successful in striking down the 5 patient limit because the CDPH&E didn't follow state rules calling for public hearings on new regulations. When the hearing were finally convened in June 2009 (as ordered by the court) the CDPH&E was convinced not to apply the 5 patent limit.
When the General Assembly goes through the proper constitutional process, like they are now, and vote to elect the 5 patient rule, it becomes law.

4 (d) A PRIMARY CAREGIVER MAY NOT CHARGE A PATIENT MORE
5 THAN THE COST OF CULTIVATING OR PURCHASING THE MEDICAL
6 MARIJUANA, BUT MAY CHARGE FOR CAREGIVER SERVICES.
Page 56
If you're a grower and provide 1oz to a patient - let's say one lamp produced 1lb in 3 months. You can charge the patient 1/16th the cost of electricity for the one lamp x 3 months, plus 1/16th the cost of nutrients and water. Then add a charge of $350 for the home delivery "service".

I have a couple of questions that are about delivery services if any one can help.
1. If I grow much more than my 5 patients can use a month am I allowed to sale the extra meds to others that are not my patients?
2. I guess this should of been the first question lol. Are delivery services even allowed under the new laws? Are they treated the same as dispensaries?
3. Am I allowed to sell 12oz to another caregiver if he has 5 patients under him?
Thanks I am sure I will have more questions after getting help on these.

No, you will not be able to get rid of your meds to anyone but your 5 patients, and all caregivers will have to undergo a background check and fingerprinting:
Primary caregivers. (a) A PRIMARY CAREGIVER MAY NOT
DELEGATE TO ANY OTHER PERSON HIS OR HER AUTHORITY TO PROVIDE MEDICAL MARIJUANA TO A PATIENT NOR MAY A PRIMARY CAREGIVER ENGAGE OTHERS TO ASSIST IN PROVIDING MEDICAL MARIJUANA TO A PATIENT.
(b) TWO OR MORE PRIMARY CAREGIVERS SHALL NOT JOIN
TOGETHER FOR THE PURPOSE OF CULTIVATING MEDICAL MARIJUANA.
(c) ONLY A MEDICAL MARIJUANA CENTER WITH AN OPTIONAL
PREMISES CULTIVATION LICENSE OR A PRIMARY CAREGIVER FOR HIS OR HER PATIENTS OR A PATIENT FOR HIMSELF OR HERSELF MAY CULTIVATE OR PROVIDE MARIJUANA AND ONLY FOR MEDICAL USE.
(e) TO PASS THE FINGERPRINT-BASED CRIMINAL HISTORY RECORD CHECK, THE PRIMARY CAREGIVER SHALL NOT HAVE BEEN CONVICTED OF A FELONY PURSUANT TO PART 4 OF ARTICLE 18 OF TITLE 18, C.R.S., WITHIN THE FIVE YEARS PRECEDING THE CRIMINAL HISTORY RECORD CHECK.
(V) THE STATE HEALTH AGENCY MAY MAKE AN EXCEPTION, BASED
ON A REQUEST FROM A PATIENT, TO PARAGRAPH (a) OF THIS SUBSECTION
(6) LIMITING PRIMARY CAREGIVERS TO FIVE PATIENTS. IF THE STATE HEALTH AGENCY MAKES AN EXCEPTION TO THE LIMIT, THE STATE HEALTH AGENCY SHALL NOTE THE EXCEPTION ON THE PRIMARY CAREGIVER'S RECORD IN THE REGISTRY.

Zed thanks so much for the accurate ass fucking info you passed on.
I have several friends that own disp's (owe wait they will probably be put out of business) and said that I could grow for them if this bill passed. I am wondering if you have any info on how that could be done? Do I have to purchases 1% of the dispensary, create my own business and sub contract, etc....
Also do you know when all of this would take effect if it does indeed pass?
Thanks again for the help brother,

I don't know about y'all but I got my shovel ready to start diggin'.
The only thing this bill will do, drive 90% of the booming MMJ business back underground. Not something that I want to do but regardless of what the government says I will continue to grow and consume marijuana.
This helps my quality of life medicinally and makes my recreational time much more pleasant. As long as I can grow, they can not stop me. I am a middle aged woman so for decades I have gone thru drug dealers, it's a shame we are going backwards instead of forwardm on this issue.
My heart goes out to those of you that have spent the last few years helping the cause and patients. To have a business you love, your good at, and is having a positive impact on patients is wonderful. To have that destroyed by our elected officals is unconscionable. For me this is an inconvience but for many of you it's a livelihood and a way of life.
Hats off.

The time has come for you
To shoot your leaders down

I think we all need to settle down. On one hand, they're fucking us. OF COURSE THEY ARE!! IF you expect ANY honor out of a politician, you're as naive as I HAVE been. So stop that. If you didn't have hopes, you wouldn't feel let down.
So what are we going to do? How many of us MEAN this? I'm in. Here's my email. Get ahold of me. What do we need? 4, 7, 10 of us who are MAD DOG about this? It doesn't take many, but is does take the committed. Remember the old ham and egg breakfast line about the difference between being involved and being committed?
Well, these guys are COMMITTED. Most of us are involved. The least we can do is get together, see where we're at and what we know. My house will work. We don't need to talk music or food or whatever, we have common ground on MMJ and the constitution, and on common ground we must stand. "But what about missing work, or the Nuggets, or this or that?" Well, these men go 24/7 robbing us of our rights, so a half hearted effort is NOT going to do the job.
These (insert word here) have betrayed the Will of the People of The Great State of Colorado, and I ask, where are the CITIZENS who will DO something about it?? We need people with testimonies (people with legit health issues, documented) people with heart, and people willing to SACRIFICE. But where are those men today? Do we have any Jefferson's, Henry's, or Washington's amongst us? We need to quit quoting them and DO what they say, live as they LIVED.
Do we have the type of men who would have been gutted and hung as traitors if they hadn't WON? That takes HEART, and "they" know we're a spineless society. But you only need a few to make a backbone, and once you do, a WHOLE BODY can form around that center of belief and courage. If your cause is righteous, the righteous will be drawn in like moths to a flame.
Let us not sleep until we resolve to either become committed or to let it go and in turn lighten up a bit. Have no doubt, you know as well as I do, this is UNJUST & UNRIGHTEOUS, and we SHOULD not let it stand. Not if we're citizens.
We, select members of this board could form a powerful team. And imagine if, on this subject at least, the people who we know in "the game" lent their hands as well as best they could. We COULD change this. It IS a RIGHTEOUS cause. We COULD. But "Coulda Shoulda Woulda".
The choice is ours. And I've made mine. I'm in. Let us see what Lady Destiny has for us.
peace.

i have been saying this for years but it seems to do no good.alot of people talk a good game but when it's time to act they can't atm cause american idol is on or something.if you try to go it alone which you could but then you are labeled a rouge by the media that is just a crazy person that just snapped for no reason.
btw did you know the gov/obama has set aside over 80k troops along with all the other un troops and so on to train for civil unrest.they plan to deploy them a in oct b4 the nov elections.just what iv'e heard.also couple that info with all of china's troops that are over here marking shit with gps and training.
sounds to me like they are trying to push everyone of our buttons until people revolt so they can then justify to our military to come round us up?now with this illegals issue az is going through sounds like another setup.now obama is talking about making all the illegals here legal.we are on a very quick and steady path to become a 3rd world nation.
i see post that say this was a country that was founded by illegals and now we don't want illegals.umm wrong know your history b4 you use that lasy brain cell thats about to burn out.this was'nt a country it was the americas no foundation whatso ever.people left a place that suppressed them.they came to a virgin land with a few rouge tribes that were scattered all over.far from unity or anything with a soild foundation.and believe it our not most tribes that were here hated each other yea some would trade and what not with each other but they fought with each other so the whole evil white man theory that came to a country"which it was not" and slaughtered for no reason is crazy.
and btw besides all of that to compare what was done back then to illegals not is just trying to side step the real issue here.here are the facts of the matter and how you can't even compare the 2.first off when they came back then they came to build a new life not come and mooch off of the work thats already been done.they came and had nothing and had to build this land from the ground up.not come here and reap the rewards from the hard work of others.there was nothing charted out here everything that was done was very hard nothing was handed to them and many died and suffered.everyone worked and paid there way everything was earned the hard way.
i know i'll get alot of hate off this but facts are facts im sick and tired of our gov taking our hard earned money and giving it away to everyone but us.how can we justify our gov having their nose in everyone elses biz and handing over all of our hard work and money to everyone else when their are so many suffering right here at home?they have trained america to hate their own and kiss everyone elses ass and if you don't you are labeled a racist and so on.wtf?illegals can come over get work get housing get free healthcare the list goes on.but you try that and see what happens.with everything that is going on here at home with the country being on the verge of collapse and and the jobless rate thats so high and were going to give the lil jobs we have to outsiders that come here not to help create or build a "new world"like our forfathers did but rather to just come and leech off it as much as they can.whatever.

Your assessment is right on ^^^^^
But trust me, things are a changin'.
They'd be changing a lot faster if even the people who have open eyes would actually DO something. Talking and getting something done have little to do with one another.
100 people on this board yapping about "injustice" and maybe 4 will actually take a chance and put in some effort, beyond voting, writing or talking, (some won't even do THAT) to make something righteous happen.
Maybe those who have kool-aid in their veins deserve to be enslaved?

what is there besides voting, writing, talking?all of which does'nt do anything.the fact is there is only 1 thing that has been the only tide changer in history.i think we all know what that is.just look at history where a great injustice has been done and then look at all the talking that took place.then look at what had to take place before anything changed.thats the bottom line...

The minorities rise up and take their rights back, we have not lost yet, we still have a fight in the courts. But we really need to get everyone vocal and active, patients, growers, dispensaries, neighbors, friends and enemy's.

We need the best of us to unite in a REAL way. Off line. There are strategic moves that can be put into motion once we have a dedicated core of players.
Until then, more talking, more losing.
