Details

Possession, delivery or sale of one-half ounce or less is punishable by up to one year in jail and a fine up to $2,500.

For delivery or sale of amounts over one-half ounce the penalty increases to 1 - 6 years in prison and a fine up to $5,000. Delivery or sale of 10 pounds or more is punishable by 2 - 12 years in prison and a fine up to $5,000. For amounts of 70 pounds or more, the penalty increases to 8 - 30 years in prison and a fine up to $200,000. Delivery or sale of 300 pounds or more carries a penalty of 15 - 60 years in prison and a fine up to $500,000.

Any sale to a minor or any sale within 1,000 feet of a school increases the penalty classification one level.

Cultivation of 10 - 19 plants is punishable by 2 - 12 years in prison and a fine up to $50,000. For cultivation of 20 - 99 plants, the penalty increases to 3 - 15 years in prison and a fine up to $100,000. For 100 - 499 plants the penalty increases to 8 - 30 years in prison and a fine up to $200,000. Cultivation of 500 or more plants is punishable by 15 - 60 years in prison and a fine up to $500,000.

For all first convictions for misdemeanor drug offenses there is a mandatory minimum fine of $250. For second convictions the mandatory minimum increases to $500 and for subsequent convictions, it increases to $1,000. For all fist convictions of felony drug offenses there is a mandatory minimum fine of $2,000, increasing to $3,000 for second convictions and to $5,000 for any subsequent convictions.

The use or possession of paraphernalia is punishable by up to one year in jail and a fine up to $2,500. Sale of paraphernalia carries a penalty of 1 - 6 years in prison and a fine up to $3,000.

thank you nowhereman, but i have already read the normal page. frankly, i was pretty shaken up after i read it. i did not want any jail time. my lawer said i would, at most, pay $500 in fines(350 for pot 150 for pipe) and 6 months probation. my lawer also said, since it was my first offence i may be able to just take some court appointed drug classes with a few screens. once i compete the classes my charge will be cleaned off my record. he also said i may get the whole case droped because i was not given a traffic ticket when i was pulled over. btw i was also never read my rights, however i am not shure that matters.

im in west virginia
first offenders get a mandatory offer of ,pleading guilty to simple possesion and have 6 months unsupervised probation,instead of charged and fined.

meaning dont get busted for 6 months and your clear,
if you do break any law and get charged during the 6 mts.you then go for that charge too.origanal possession,

lawyers are for the most part all sneaky lil fuckers
court appionted ones are clowns those like us would have no chioce but to use and most times lose

i shure hope my lawer will be respectable; i have a meeting with him soon, and will see if i think he will be worth it...after all he wants to charge me $500 himself and i don't just hand out $500 bucks without a good reason!

Dude, good luck. I was caught last February with only about 9 grams, but I was an idiot, and it had it separated in bags. So I'm being charged with a felony right now.. can you believe it? Less than 9 grams, and I'm being charged with a felony. It's ridiculous. My lawyer is *trying* to get it down to a misdemeanor so I wouldn't have to do any jail time. He said the worst thing that could happen is 60-90 days in jail... I ain't really lookin' forward to that. I gotta go to court today, actually. wish me luck.

good juck westcoast, i went to talk to my lawer today and he said....i should try to get a "diversion", which basicly means i will have to take drug classes and be on probation for one year. otherwise, i will have to pay fines, still have a year probation, and will be drug tested either way. i'm so bummed to have to quit smoking for a whole year!! i haven't quit for more than a few days, and i've been smoking for almost ten years!!

Hey yo.. I just got back from court right now. Man, oh man, do I feel relieved. Basically, my lawyer told me we're going to do a "best interest" plea. So my case has been dropped down to a misdemeanor. I pleaded no contest to having more than 28 grams (even though I didn't, which the records show). Now I have to do 40 hours community service, and I got 2 years probation, but I don't think I gotta do drug tests.. ahh.. but I'll take it over jail time, that's fo sho.

Time to sit back.. and smoke up! lol

hery u guys atre having some bad luck over there.reading nowheremans post really shocked me.
im in england & now cannabis is graded as class c drug.the cops dont bother bustin your ass for small growers.its the bigger fish they want.but anyway,good luck with the courts

yes it means they dont even wanna see you
they dont ask you to anything but stay out of trouble for that time
matter of fact it mean they "better not" see you (in court agian that is)
it just a way for first offenders to not take up jail space they dont really have
and most are to poor to pay a fine so,
its like,
strike one,slap on wrist,
first offenders only can get this and they must offer it to you here.
but its a ticket at most here,a fine. if you dont take the unsupervised probation deal,its a fine only but its in paper ect,
and that would be only under 15 grams.
like i say anything over its a new ball game here
