Something the same principle, but completely different scenerio i once read about.
A son was coming home from college, and told his parents he'd be home the next day. He for some reason left early, and was going to sneak into his house at night, and surprise them in the morning. When he got home, he realised he forgot his key and snuck in through the broken window that his house had.
His father thought it was someone breaking in, and shot and killed his own son. The father, who now has to live with that guilt, wasn't charged with murder, as he was protecting his wife and himself, and his son was breaking and entering.
I don't think the dude should be charged, because it was an honest mistake, but he probably should have to pay for the damage to the door.

Paying to have the door fixed is fair I think. Charging him like he was trying to break in and steal shit is just dirty. I hope the DA looks at the case and just laughs and throws it away.
The guy was just listening to porn, but it was loud enough to hear it on another floor. He had it comming to him.
You keep stuff like that private for a reason. He prolly had it on the big HD tv with surround sound. Like the other guy said, get some headphones damn ;)
