i had a friend here in michigan that flat came out and told the judge and his probation officer that he has his card for MEDICAL REASONS and he was allowed to use it still just like if he had prescriptions. they cant take away ur prescriptions. ide talk with his attorney and have it brought up, cuz my buddie is now allowed to drop dirty for that, just has to pass breath tests and do a.a. classes....its kinda 1 of those gray areas
Yeah a lot depends on which state you live in and how knowledgable and unbiased the judge will be in the case. But its certainly an arguement you should bring up with the attorney. He will have intimate knowledge about the judge you will be dealing with. If he's a liberal judge you might get a break.
We're in a small town in Oregon, and know the judge is a hard ass towards DUII, but I don't know about MM. His wife was killed by a drunk driver years ago, so I've heard. I don't know who his PO will be yet, but I guess we will find out. He will be staying with a friend who lives 5 minutes from his work, when his suspension begins. The question for the judge I guess is what is more acceptable, use of MM for his pain, or the use of Oxicodone for his pain that does become addicting, and does require more and more for relief from pain.
He is being evaluated for early onset Alzheimer's Disease also. He's been having symptoms of short term memory loss, poor judgement (as seen by his duii) and repeating things, or asking the same questions over and over, and the agitation from too much stimulation. His mother, 2 uncles and his grandfather all had early onset Alzheimer's disease. Hubby will be 60 late this year. Yes, my life sucks, not to mention my own pain level from disease.
I honestly don't think u and your husband will have a problem especially from wut I here about mm in Oregon just try and fight the argument. Best of luck with your situation
If you lose in court then find a family and trusted friend, that can get a OMMP, or rent you space. If I recall in Oregon ( I am in Oregon) you can grow even in rented space. So if a pal wants to rent you space they could rent it or become a grower for you and solve it that way. Just make sure its all nice and legal and that would be a way out to still grow.
