Car searched, nothing found....dumbasses!!!

I was driving one day (recently) and I got pulled over and a cop gave me the usual bullshit.....so i gave my id and all that to him and he went back to his car, came back and asked me to step out of the car.

..so i went to the back and he basically said 'i smell marijuana in your car, do you have anything you want to tell me about?'

"...damn!" i thought. "I aint goin to jail!"

"NOPE! I dont even smoke weed!! ...i mean i have, just not within many years."

it was hard not to laugh because i was so fuckin stoned off of some dro i had *JUST* finished smoking.


so needless to say he searched my car. then, when he found nothing, he called his asspal over to search my car. still nothing.

what morons, there was a bong underneath the passenger seat made from a water bottle wrapped in a bag. they didnt even notice it. ....so they were searching my car for literally an hour or so, right? So they dont find shit, but he pulls this like smallass immiture marijuana seed off my floor,.....i didnt even know it was there, musta been lookin pretty damn hard...and said that he was gona test it to confirm it was pot.

'OK.' i said confidently, because i knew that he was 1) obviously an idiot. 2) completely missed the fucking BONG (my heart almost exploded standing there) 3) theres no THC in a fuckin seed. DUH.

so he tests it, come back and said 'your going to jail.'

my heart dropped. what??! it cant be! FUCK THAT!

then he said 'it turned purple,....that means its pot. your going to jail.'

HAH! BIIIIIIIGGGGGGG MISTAKE!

i got busted several years ago for graffiti. i had some herbs i bought from the mall and a pipe i smoked it in and when i got caught they tested it. it all turned purple and the cops said 'damn. we thought for sure it would come up as pot.' got my (well, my friends, actually...and no that story didnt work with the pigs) pipe back along with the herbs and got arrested for the graffitit....

but anyway, the point was that i knew that was bullshit...and its supposed to turn BLACK when its pot.

so naturally, since i dont wana get ass-raped i called him out and told him that little story there.

his partner kinda mouthed the word 'shit' out of the corner of my eye. i wanted to punch that cocksucker in his faggot-ass face (no im not homophobic).

so he went back to his car and TOOK THE FUCK OFF! his parter (who was standing right next to me) looked as suprised as he did...handed me my ID and said 'slow down' (he pulled me over for 'speeding'.

so basically, what im wondering is since they found nothing and obviously couldnt do anything about it could i have sued them or something since i said "NO." to a search.

i even explained BEFORE he searched that i had smoked a 'black & mild cigarello' just a few mins ago and my eyes were red because i had been up working since 7am (true story) and it was like midnight.

think i would have had a case?

think i coulda got some money?

if they smell weed in the car then that is probably cause.. and you pretty much lose a lot of your rights... at least thats what i think..

Smell of marijuana is probable cause. Reading your post you dont seem to have said no to a Search of your car, but either way, he said he smelled pot, and its your word against a cop...so your pretty much out of luck. Just let thm search your car, even if they found the bong, they couldnt do anything but have a reason to search your trunk....bongs arent illegal...except in Philly

you dont need a warrant to search a car, you only need the persons consent.
you need a warrant to search someones house. or an invitation.
anyways, just dont allow a cop to get into your car, house, or bag, if you dont want to. that is in your rights
