Alright, this is in Hesperia California of San Bernardino County.

My friends Justin and Jerred were at Justins house just chillin. A few hours before, this guy Taylor who is there all the time accidently called the Popo at about 3 pm. He meant to press 912 on the phone, but ended up pressing 911 and called the police. He hung up, they called back and he said that he did it accidently. The police asked for a name, Taylor gave them a false one of another person who lived there.

It's about 6 pm, and Justin is inside just hanging out with about 3-4 other people. A single squad car rolls up(who nobody noticed) but the people were expecting the police to show up eventually to investigate the false 911 call.
The cop walks into the house with no warrant, and he lets himself in. Justin comes out and the cop talks to him for a second. The cop says "I need to check around the house." Justin says " I do not consent to any searches of my house." The cop grabs justin by the throat, throws him against the wall and yells at him "What are you gonna do?!" He throws justin off the wall and marches back to his room. The cop walks in his room, says "this your room?" Again Justin says "I DO NOT CONSENT!" The cop chokes him out again and begins rampantly searching the room.
Justin has a med card, so he had pipes, bongs, papers, bud, scales, baggies, all that shit out. But Justin also grows, he had 5 different Kush plants in flower which are all in his closet. The cop comes tearing in, sniffs around and looks for where to cords lead to. That day, the whole room and especially the closet WREAKED of bomb Kush. He finds the plants, puts the handcuffs on Justin. Justin says he has a med license and pulls it out from the desk. The cop yells at him "This doesn't mean SHIT TO ME! I"LL TEAR IT UP RIGHT NOW!" The cop confiscated the plants because he said that in his law book that Justin was allowed to have all the pipes and stuff, but not plants? In SB 420 and P. 215, growing plants was apart of that, 6 mature. He had 5.
The cop continues his search and finds his 22 rifle and starts pointing it directly at him. Justin says "what the fuck? Don't point that at me, it could be loaded." The cop says "so what, it's just a bb gun. What, what?" Justin's told to sit in the chair in his room and the cop just keeps pointing the gun at him to his face and body while justin is moving around the chair but not standing up to dodge the muzzel. Just then, my boy Jerrod comes in and is like "What the fuck officer? Why are you pointing that gun at him? Stop!" The cop says to Jerrod " You live here? No, get the FUCK OUT!" As Jerrod is exiting the room, the cop follows him out there and places him under arrest. Jerrod says "What am I under arrest for?"
"Attempt to distribute." The cop then begins to search Jerrod's person, takes out his wallet and just flips through it carefully. So Justin and Jerrod are in cuffs while the Cop searches the house.
Another Cop showed up, a Seargent, and starts taking the plants out of the house including the lights and co2 and all that shit. The Sgt, was kind and easy to deal with and didn't fuck the plants, the other dude destroyed them basically. When The bubba kush plant came out, 4 weeks into flower, the main stem was snapped in half because that Other fuckin' dick cop just dropped those plants right into the bag with no care.

Finally, the Cop says to Justin and Jerrod, "Alright, the cuffs are coming off, but, we have to confiscate the plants." The cops leave, then came back about 4 hours later and dropped off no tickets, no court date things, just Justin's med license. That's it. No charges, no nothing.

So, we've decided to conjur up some money, hire a lawyer, and sue the goddamn pants off these mother fuckers.

Oh, one more thing, the first cop that came, when he went outside to talk to his Sgt, told his Sgt that the
- Door was wide open
- Justin REFUSED and put up a fight
- He felt that his life was in jeopardy.

And when he called in for Backup, the cop "Yes, we have marijuana growers." I guess he felt he was doing the right thing and was having a ball. He got 5 plants, he made it sound like the whole room or house or soemthing. AND both Jerrod and Justin have med licenses. Ooh, this is going to be goooood. Plus all the witnesses over at Justin's house, real ones too!

Mother Fuckin' cops, well the ones who fuck with your shit and be a Cop just to be a dick.

You've got a mighty dramatic story there. Almost so dramatic that it's suspicious. However, even if it all went down just the way you recounted it, your bubble's going to get burst. You can definitely sue. And if you are able to support litigation, you might even make a case if the cop hadn't already lied on the record about how it all happened. That first jerk definitely sounds like an outta control cop. But I don't think you or your friends have any idea what a lawsuit like that will cost you--or what it takes to make a real case. More than the word of some plant-growing med users (the judge and court will see you as "stoners") against sworn law enforcement officers. Who, incidentally, are automatically deemed to be upholding a higher degree of truth and justice before they enter the courtroom just because they're sworn officers.

You're going to need to "conjure" up about $25,000, and that's not going to last you much longer than six months--nine if you find a cheap, newbie attorney. When you get ready to go to court or keep supporting the attorney until the PD settles, the price is going to get higher.

Cut your losses. Lock your doors. Grow some new plants. And make sure you're dialing the correct numbers on the phone next time. LEOs are within their rights to investigate 911 calls, and they can enter without warrants to do so if they fear someone's life might be in danger, which is what that cop'll say he was doing. An ethical and good attorney will likely give you this same candid advice. If you're smart--and you don't want to lose a lot of money you don't have--take it.

^ I agree, its gonna cost a hell lot and its not gonna be an easy case to try. What I would do is find out where the dickhead pig lives and give his house hell. I mean totally trash the fuckin place. Then again I have anger issues :jointsmile:

I remember a case similar to this happened also, where the person meant to dial 411 and dialed 911 by mistake. Cops broke in and kicked the dude so hard they broke his ribs and arrested everyone. Its the most stupidest law ive ever heard of, and its sad that this is allowed in this country. Hope everything works out for you.

In SB 420 and prop 215 for California clearly state that a card holder may grow up to 12 immature plants or 6 mature(flowering) plants.

This is all hypothetical, if I was going to pursue this case myself (and had no money to do so) which I am not, and is this posting is to be in no way intended as legal advice for anyone who reads this, specifically DemoCammondo.

Southern California is the Ninth Circuit for the federal judiciary system. I believe there is a federal district court somewhat near me in Los Angeles or San Francisco. I would contact that court and respectfully request a pro se 1983 civil rights vioalation lawsuit packet. Also, respectfully request the filing packet for Proceeding in Forma Pauperis. (that means I'm a poor person and cannot pay the filing fees for this lawsuit but should still be allowed to proceed to a judge to tell my version of why I believe that my Constitutionally Guaranteed Right to Privacy was willfully and wantonally violated by someone "acting under the color of state law" i.e. a sheriff, a state trooper, a city policeperson, a deputy.)

Both packets are easy to file. I would simply answer the questions of why I believe my Constitutionally Protected Right to have some local cop bust into my house without consent and without probable cause. Altough, I would absolutely, as the Plaintiff in this lawsuit, with proper argumentative basis, clearly explain to the judge that this cop did not even have reasonable suspicion.

Anything you file as a pro se plaintiff the court must construe liberally. that means you don't need to know anything about legal filings.

The Court will rule on my Forma Pauperis motion. They always grant it, you claim you have no job and can't pay).

If the court decides that my case has merit, they will notify me that I must buy the "Court Rules" (usually for only five or ten bucks and that usaully includes postage) and you must abide by those rules as a pro se plaintiff. And they will notify me to Apply for the US Marsahll to serve the defendants the civil rights violation lawsuit. they will hire a real lawyer and they will claim "Quailified Immuntiy" and you gotta know what to say to get it past that point my friend.
