As some ballots were still being counted, the powerful National Rifle Association announced Wednesday it would file a lawsuit to overturn a ban on firearms approved by San Francisco voters just the day before.
The conservative group said Proposition H violates ??federal guarantees? and various state laws in California. The measure, which received the backing of a solid 57 percent of city voters, bans the sale, distribution and manufacture of firearms and ammunition in San Francisco and limits the possession of handguns to those who need them for professional reasons, such as police or security guards. It was placed on the ballot by four supervisors.
??This is a hollow victory for the gun control lobby because this scheme is in clear violation of California law,? said NRA lobbyist Chris W. Cox in a statement. ??We will file suit and fight this to the highest courts in the country until good sense prevails once again in San Francisco.?
The lawsuit came as little surprise to supporters and opponents, who predicted throughout the campaign that the proposition would ultimately be decided in the courts, not at the ballot box. City Attorney Dennis Herrera said he has not seen the challenge yet, but he believes there might be leeway in state law for Proposition H. He said the California Supreme Court has left ??the possibility open that local government can take a role in curbing gun violence that plagues our streets.?
??I think we have a lot of strong arguments put forward,? Herrera said. ??I intend to mount an aggressive campaign.?
A previous attempt by city voters to ban handguns was struck down by the courts in 1982. The court held that state law, which allows state residents to keep a firearm in their home without a permit, trumped the local ordinance. Herrera said the current ordinance was crafted to avoid the pitfalls faced by the older ordinance.
Meanwhile, city officials grappled Wednesday with how to institute Proposition H, which is scheduled to go into effect on January 1. The proposition gives residents the opportunity to surrender handguns to police or sheriffs by April 1. The Board of Supervisors also has the power to establish penalties for possession of handguns after the 90-day surrender period.
Mayor Gavin Newsom said The City would take a ??thoughtful? approach to implementing the law.
??We could go out and start arresting people, but that wouldn??t be prudent. There needs to be a process here,? Newsom said. But he also expressed doubts about whether the proposition will survive a court challenge: ??I imagine they will have a very strong case to throw this well-intended initiative out.?
