Legal Advice needed/ ???

so i recently got caught by the fucking cops.......in Utah (First offense)

i was just chilled with ma buddy sitting in his car hitting a damn fine bubbler at this one spot pretty close to his house up on a hill [smoke] . me and my buddy were stoned as fuck and i was drinking that night as well. well it just so happened that some little bitch kid drove up in his fucking dirtbike and reported us to the police. me and my friend thought nothing of that shit until like 3 cars were coming up the hill from different directions. so we dipped and one of the cars started to follow us. surely enough it was some po-po. [Frown]

so we stopped and when they got out of the car we rolled down the window and they smelled it immediatley (Now all 3 cops were there). they were a buncha power-hungry egotistical dicks. now at this point i was so fucked up i didnt even know what was happening. they searched my friends Mercedes without declaring that they were going to do and just put us in handcuffs. they found all my shit. luckily i only had a little over 2 grams at the time.

well anyways they didnt read us our rights
they didnt tell us what we were being arrested for
they didnt ask us before searching the car
im pretty sure they didnt even declare we were being arrested
and they were fucking dicks! [Mad]
i got charged for possession of marijuana (little over 2 grams)
contributing to delinquency of a minor (my friend is only 17, I'm 18)
possession of paraphernalia (lost my sick 50$ bubbler)
illegal consumption by a minor (blew a .011)
and possession of tobacco (Utah tobacco laws are fucking gay and unconstitutional)

i was sent to jail for a night til my friend bailed me out witha bond at like 4 am
initial fine= $2,300 bucks

so my question to you good people is does anyone know how i will be charged and what i will have to do????? community service? probation? Drug/Alcohol classes? final fine? suspended license? misdemeanors?????????????????????? [Confused] [Confused] [Confused]

also any advice will help (not "don't get caught" or "don't do that next time")

A friend of mine was busted except he had a lot of pills and marijuana in his system. He got a night of jail paid a fine got a first offense and that was that man. So.. As long as it was a small amount you should get a fine. Depending on the cops and the judge you may not want to fight about the rights and everything else you'd fight about. That may just cause you more trouble than is needed and you'd get off easier without the whole arguing. That's my opinion. Tell me what ya think.

I'm not in your jurisdiction, but my son had the same kind of thing happen when he was your age and his friend was 17.

They didn't try to run, so they weren't quite as hard on them.

He ended up pleading no-contest so he didn't have to go through ASAP (the drug & alcohol program) - the charges were reduced to just paraphalia, he got 30 days suspended, and that was that. If he was willing to do the classes & get tested for a year, he could have cleared his record.

Here's a few legal points for you - as I understand them (I'm not a lawyer)

Contrary to public opinion, they do not have to mirandize you. However, if they don't, it can mean that some things you say "may not" be admissable.
Best course of action is to never say anything until you talk to a lawyer - even if that means you go to jail.

If they smelled pot, that's probable cause & reason enough for a legal search.

As far as the arrest, as soon as you feel like you're no longer free to go, most lawyers will argue that you're arrested at that time.
I'm not sure that they have to tell you what you're charged with right away.

If you want to know how things turn out in the Utah courts, go to court & watch for a few hours.
It's free to the public and you'll know what you're facing. Some states also have court cases & verdicts in an online database that you can search.
I'm betting you don't do any jail time, but everything else is a definite possibility.

Have you talked to a lawyer?

They're trying to scare you with all those charges because you guys tried to get away. I bet a lot of them - like the contributing - get dropped.

Yep talk to your court assigned defense attorney and see what he says about plea bargaining. Thats really your only choice at this point. They had reasonable cause to search the vehicle because of the alcohol and pot smell.
A lot of the extra currricular punishments are up to the judge most of the time depending on what the prosecutor recommends. Alcohol and drug classes are probably highly likely.
