Ok, here it is. We need to rally in Olympia on Monday, at 1:00 p.m. to show our support in killing SB-5073. This trainwreck of a bill is scheduled to be before the House Healthcare and Wellness Committee on Monday, March 14, 2011 at 1:30 p.m. in the House Hearing Room "B" in the John L. O'Brien Building located on the Capital Campus (15 Ave.SW/Water St. SW). Please realize the importance of stopping SB-5073 before it is passed by these ignorant legislators. Post your support and let us know that we can count on you to help us. We are against outside forces trying to trick patients into believing this is a good bill, I know because I have talked to them. Show them who we are and our true strength by showing up in Olympia with us to send a clear message to our legislators to kill this bill. I've posted this on THCList in hopes they will join us in spreading this message. KMJ.

The bill that was supposed to CLARIFY the gray areas of our industry has lost my personal support. Unfortunately the bill that started with great intension has picked up some â??Extra Baggageâ?� that I (personally) feel is now detrimental to this bill. So at this time I can no longer support the bill as itâ??s currently written. This bill had everything it needed to be great law until the recent amendments were imposed.

I feel after watching the vote live last week and seeing exactly how much momentum itâ??s got and time they gave our bill, something WILL get passed if we donâ??t oppose it now. The WCA stance differs from mine just a little and Ezra will be putting out our Associations action alert here shortly.

I want to be clear that being part of a democratic organization such as the WCA one person may not always get his/her way. I feel it important to go with the majority vote - I was not the majority at the last meeting, I was very much the minority vote. The WCA is not far behind my personal views, we as an Association voted to support the bill to the HOUSE and then if the â??Extra Baggageâ?� isnâ??t fixed at that point we (The WCA) would withdraw our support for the bill and move to kill it outright.

We all agree that parts of the bill as they are NOW written need major fixing, the only part we disagree on is when we should apply the brakes. I hope I am wrong.
I would also hope the House Health Care committee can see the errors in the new amendments, but I think Iâ??ve seen enough of how our government works to know it will be very hard to make up all the ground that was just lost.

We learned a little while ago that 5073 will be heard in the House Health Care and Wellness Committee on Monday 3/14 at 1:30 p.m. in House Hearing Rm B in the John L. O'Brien Building on the Capitol campus in Olympia. As I mentioned before Ezra will be sending me an action alert here shortly. The fight isnâ??t over, but it sure just got a lot more scary.

You have to wonder about the timing. On the very same morning that a Montana Senate committee failed to endorse a bill that would have repealed the state's medical marijuana law, federal agents, with guns drawn, hit at least 10 dispensaries across the state Monday.

"The timing is impeccable," said Chris Lindsey, a Missoula attorney who specializes in medical marijuana cases, reports Gwen Florio of The Missoulian.

"They're seizing everything -- plants, marijuana, grow equipment, files and computers," Lindsey said. "It's very, very broad in its scope." The attorney said he retains a business interest in Montana Cannabis, one of the dispensaries where federal search warrants were executed.

Employees and clients stood around outside the Missoula branch of Montana Cannabis early Monday afternoon. The shop shut down after Monday morning's raid.

"We're closed," said employee Toni Ware to clients as they pulled up to the shop. "We're closed," she repeated.

"They even took our cannabis-infused lotion," Ware said a minute later.

Included in the federal raids was the huge Montana Cannabis greenhouse in Helena, with agents from the Drug Enforcement Administration, the Bureau of Alcohol, Tobacco, Firearms and Explosives and the FBI, with Lewis and Clerk County and the Helena Police Department taking part, according to The Associated Press.

At least eight people were led away from the greenhouse in handcuffs, according to the AP report. Employee Brett Thompson, 30, said federal agents questioned each worker individually and then released them, except for one worker who had an outstanding warrant, reports CNBC.

Inside, agents in DEA and FBI jackets wearing respirator masks and blue gloves jerked waist-high plants from their pots and hauled them away out of sight, wrapped in blue tarps.

Montana Cannabis co-owner Christopher Williams told The Associated Press that raids were taking place at other dispensaries, including Big Sky Patient Care in Bozeman, at MCM in Belgrade and at Good Medicine Providers in Columbia Falls.

"It's strictly a political move to stop us from providing medicine to sick people," said Williams, standing outside the fence at Montana Cannabis.

Barbara Trego, Williams's mother and another worker at Montana Cannabis, said some of the people who use the company's marijuana are cancer patients and she feared what would happen to them if the operation shut down.

"We weren't trying to hide anything," Trego said. "Our windows are open. Our door was open. We've got patients that could die just by what's happened today."

Williams said of the 1,680 plants inside the greenhouse near Helena, 480 were flowering plants that produce about five ounces of marijuana each. He said he sells ounces for $190, meaning about $456,000 worth of marijuana was "seized" from that one location.

"Word is coming in literally as we speak," said Kris Hermes, spokesman for Americans for Safe Access (ASA), a national group which advocates for medical marijuana patients.

Like Lindsey, Hermes noticed that the raids coincided with Montana's legislative action.

"This smacks of officials, whether law enforcement or hostile local public officials, not getting their way and sidestepping the democratic process to shut down legitimate providers," Hermes said.

According to Americans for Forfeiture Reform, the raids appeared to be "smash and grab" operations, where businesses which are legal under state law have their cash, inventory, computers, bank accounts, and other property violently seized by federal agencies who directly profit from those seizures.

"Worse, since these seizures can happen prior to any criminal charges being filed, victims are often unable to obtain paid representation by an attorney," Eapen Thampy wrote at the AFR site.

The federal warrants were sealed, according to the U.S. Attorney's office in Helena.

Don't be naive. A big problem with people in this movement is they fail to recognize when bad situations are in fact justified by authority. If you shoot a swat team member, even after they fail to identify themself, three things will happen:

1.) you'll be killed by his team members.
2.) the raid will continue as planned.
3.) nobody will ever question your death.

We all know how horrible this is, but we have to stick to our approach of reason, compassion, and an unbreakable will. They don't have the resources to incarcerate us all, and even if they did it would be so many people that it would never be allowed. Keep working to change hearts and minds by giving people real information, it will pay off in the end.

I remember people always used to talk about the 'RICO ' act on the forums a lot. Didn't that apply to crimes where several people are involved, I've never looked it up. Anyway the Tacoma Cross went down today and 8 people were charged. Feds probably would have soon anyway...

Eight charged in Tacoma medicinal marijuana dispensary case

Pierce County prosecutors have accused the owner of a Tacoma medical marijuana dispensary of running an illegal network of pot-growing operations across two counties.

They allege in court documents that James Canyon Lucas, operator of Tacoma Cross, managed grow sites in Pierce and King counties and supervised the illegal distribution of the harvested marijuana.

Lucas, 31, has been summoned to court Nov. 12 for arraignment on charges of unlawful manufacture of a controlled substance, unlawful possession of a controlled substance with intent to deliver and money laundering.

Seven other people also are charged in the case, including Lucasâ?? business associate Mark Dewayne Nowels, 40. Nowels is charged with unlawful manufacture of a controlled substance and money laundering. He, too, is to be arraigned Nov. 12.

A team of law enforcement officers from across the South Sound region began investigating the men in March after receiving information that they were illegally growing marijuana, court records show.

In July, officers served seven search warrants at homes in Federal Way, Sumner, Bonney Lake, Fife and Lake Tapps. They seized marijuana plants, growing equipment, firearms, cash and other drugs, court records show.

They also found receipts from Tacoma Cross in a bagful of cash discovered at Nowelsâ?? Lake Tapps home, the records state.

Nowels originally â??claimed to be an authorized grower for various marijuana patients and claimed that he donated his marijuana to the Tacoma Cross dispensary,â?� court records show.

He later changed his account, allegedly telling investigators that Lucas recruited him into the illegal network when his real estate business was struggling. Nowels said he expanded his operation once he started making money, records state.

â??M. Nowels claimed that he and J. Lucas would manage the power bills and the rent locations and make the tenders responsible for the marijuana,â?� deputy prosecutor James Curtis wrote in a declaration for probable cause. â??J. Lucas was responsible for the distribution of the marijuana.â?�

Detectives examined the bank accounts of Lucas and Nowels as part of the investigation.

â??Both M. Nowels and J. Lucas have made substantial banking deposits and accumulated homes and vehicles, which are disproportionate to their reported incomes,â?� court records state.

Nowels deposited more than $767,000 into his accounts between 2007 and 2010, the records show.

Efforts to reach the men were unsuccessful Tuesday.

A manager of Tacoma Cross, 1126 Commerce St., told The News Tribune last month that the dispensary serves about 1,200 patients.

In May, authorities raided a Tacoma medical marijuana dispensary, Club 420, and arrested two of its operators, alleging they sold marijuana to people unauthorized to buy it and illegally profited from sales.

Last month, the city ordered eight dispensaries in Tacoma to shut down. It later rescinded the cease-and-desist order to allow the Legislature to clarify the stateâ??s medical-marijuana law.

5 arraigned in marijuana dispensary case

Five people charged in connection with what authorities say was a sophisticated two-county marijuana-growing operation pleaded not guilty Friday in Pierce County Superior Court.

Prosecutors say the five conspired with James Canyon Lucas, owner of medical marijuana dispensary Tacoma Cross, to grow pot illegally at several houses in Pierce and King Counties.

Arraigned Friday on charges of unlawfully manufacturing a controlled substance were:

â?¢ Ryan Needham, 29. Judge Rosanne Buckner ordered him to post $25,000 bail by Monday or be booked into jail.

â?¢ Kaelah Singleton, 26. Buckner released Singleton on her personal recognizance.

â?¢ Kari Levi, 42. Buckner released Levi on her personal recognizance.

â?¢ Loren Gordner, 30. Buckner ordered him to post $20,000 bail by Monday or be booked into jail.

â?¢ Mark Nowels, 41. Buckner ordered him to post $35,000 bail by Monday or be booked into jail. Nowels also is charged with money laundering in the case.

Lucas, 31, and his wife, Sarah, 29, also are charged in the case. Their arraignments were put off to Monday. Another co-defendant, Edward Dumas, 40, is to be arraigned Nov. 30.
