On Monday August 9th, the Denver City Council will hear a first reading of an ordinance to BAN caregivers from growing medical marijuana for any patient in any residential zone district. The ordinance will make it a zoning violation for anyone to grow more than 12 plants in any residential zone district. In addition, the 12 plants can only be grown for patients who live at that address. This ordinance will effectively ban the caregiver model of safe access in Denver!
It gets worse.....
Ordinance C10-0607 is being introduced by Councilmember Jeanne Robb, who admits that she did not consult a single patient during the drafting process!
The ordinance will be heard for a first reading on Monday night at 5:30p. If it passes first reading, a public hearing will be scheduled for sometime in September, along with a final vote.
Please call you city council representative TODAY and tell them to vote NO on Ordinance C10-0607. The city council should send the ordinance back to the drawing board and draft an ordinance that regulates - not bans - small time caregivers in Denver.

Seems unnecessarily punitive to me. Plant limits and zoning restrictions are fine and dandy, but the requirement that the patient live at the same address is problematic, to my mind. I'm sure there are a lot of patients who cannot grow at their own addresses, even if they engage the services of a caregiver.

Wow :mad: absolutly rediculous! I don't live in Denver but you can be sure if it passes there other cities will follow.
I think it's going to take a 100,000 patient march to fix all this BS that they're trying to push on us.

SECTION 11.8.4 GARDEN
11.8.4.1 All Zone Districts
In all Zone Districts, where permitted with limitations:
A. A garden shall be maintained, including necessary watering, pruning, pest control, and removal
of dead or diseased plant material.
B. Detached accessory structures incidental to the garden use, such as accessory storage or utility
buildings, gazebos, trellis, or accessory greenhouse structures, are permitted subject to compliance
with all applicable building form standards in the subject zone district.
C. The growing of medical marijuana shall comply with the following:
1. No more than 6 plants may be grown for each patient registry identification card holder
residing in a dwelling unit, not to exceed 12 plants per dwelling unit.
2. Growing and/or storage of medical marijuana shall occur within a completely enclosed
structure.
3. Growing and/or storage of medical marijuana shall not occur in a common area associated
with the dwelling unit.
4. Growing shall be for personal use only by patient registry identification card holders
residing in the dwelling unit; retail or wholesale sales of goods or products derived from
the growing of medical marijuana and any off-site distribution of such plants or derived
products are prohibited.
11.8.4.2 All Residenti al Zone Districts
In a Residential Zone District, where permitted with limitations:
A. Retail or wholesale sales of goods or products derived from the accessory a garden use accessory
to a primary residential use are prohibited in a Residential Zone District.
