"A hunter led investigators this week to a man they say ??interprets the medical marijuana law a little differently than we do.?
Benjamin A. Rice-Erso, 26, was released from Spokane County Jail on his own recognizance today after appearing in Superior Court on a felony charge of manufacturing a controlled substance.
Investigators raided his mother??s home at 15100 block of South Valley Chapel Road Wednesday after a tipster said he saw marijuana plants on the 10-acre parcel while hunting with a GPS unit, according to a search warrant filed today.
A detective flew over the site in a helicopter, leading to a raid that seized 181 marijuana plants and 5 pounds of harvested bud. Detectives also seized $3,200 found in a gun safe, according to the search warrant.
Spokane County Sheriff??s Office Sgt. Dave Reagan said Rice-Erso, who has a medical marijuana license, equipped two trucks with reservoirs so he could drive water to the outdoor grow site.
State law allows medical marijuana patients to keep 15 plants and 24 ounces of the harvested drug. Local police and prosecutors consider anyone distributing marijuana to more than one authorized patient to be violating the law, which allows for distribution to one person ??at any one time.?"

looks like this might be a Sentry patient as cannacare.org has a discussion going on about it.
Their recommendations say something to the effect of, "as this patient's 60 day supply I recommend as many plants as they feel is needed"....
So I guess this guy feels 181 plants is needed....I wonder if they are going to put this to the test in court....though the 5 pounds of processed might be hard to explain, maybe they can argue its not "usable" because it wasn't dried/cured totally or something.

Was it the perpetrator's land? And was the hunter trespassing, because I doubt I would let someone hunt my land if I was growing that much buds. I bet he can get shit dropped if he says that the evidence was gathered unlawfully.

Seems you may be correct here...test case yep, learned from Mr. Paul Stanford himself...sad. Another doc-in-the-box bust....when will this stop justpics??
His year supply is more the correct argument...which is totally reasonable when broke down by 60-day supply presumption. If this person feels the need to do a 1 yr. crop to get his medicine.

By my calculations using the governments numbers here, they owe this guy 2.6 million for taking his medicine...and that's just the medicine value...
This is gonna be a great one to watch if this guy goes to trial or the state dismisses the charges...hope steve helps this guy as he said he does help "ALL" his patients with legal advice...clock them fools with the timber trespass stautes...they will never ever pull another cannabis L. sativa plant again...

My crystal ball is telling me he gets charged with some at least as serious with manufactor of 100 or more with intent to deliver, and the potential jail time envokes a plea deal of some sort.
Time will tell. Hope he fights and wins but that'd be a tough one.

But of coarse he will be charged with some outrageous crime and bent over to take the plea...tis how it works mang.
The question(s) are here: does he have enough "sand" to endure the stress of the game.:D And will steve and the signing health care practitioner back his growing cycles.
I did the math of a 1 yr. grow for outdoors and he is totally within the bounds of a non-discriminatory statute which offers equal protection to those of an indoor grow as our 60-day supply presumes...try and do an outdoor grow every 60-days...
The statute discriminates against those whom grow outdoors, because the outdoor season is the controlling factor for any patient to come within the bounds of the law.
So if it was me, I would scream discrimination to high heaven..cause all the elements are ripe.

If he's got the money for lawyers he could try to pull off that argument. Outdoor has its season to grow Meds so if he says he was trying to get off a years worth of meds in one load.
