Hey Guys...im Jeremy. I live in Louisiana.
I had a situation develop at work last week, and really could use some advice. First and foremost my company has no drug policy for drugs. My boss called me friday and asked me to go in for a urine analysis. I agreed and went to a local shop and got some quickfix(which worked great, formula5.7).
I just got off the phone with my boss and he wanted me to go in the morning for a blood test to prove im not on the grass.
Guys is this legal??

The company basically has the right to do whatever they want as far as drug testing their employees. They could test you every day if they wanted and there's really nothing you can do about it. A lot of places now are dropping randoms on people more often in these tough economic times in order to "thin out the herd" without having to play UI benefits.
I am not as familiar with blood tests as I am urine tests, but I would think that once the THC goes through your blood from your lungs and is metabolized, it is then stored in your fat, and is absent from your blood. I would think that if its in your blood, you would still feel the effects of it and once you're not stoned you're in the clear, but I just googled detection times and Erowid claims 2-3 days for casual use and up to two weeks for frequent users. Hopefully someone a bit more knoweldgeable with blood tests can chime in.
It sucks, but I'm afraid the employer has the right to test you as much as they want. If your job doesn't have a written drug policy, and they fire you for testing positive for drugs, you could at least argue to the UI people that you were not in violation of any written and understood rules, but before you do make sure and check every line of the company handbook. See the problem is my helper has been trying to get my job. He's running around basiclly 'slandering' my name. So I proved to the employer, by taking a urine test I wasnt,or quickfix wasnt on drugs. He's claiming I drank something to pass it, but looking at my quest paperwork....they test for adulterants.
They still feel the need to harass me, so im going to talk to a lawyer this morning. And see what my options are.

Blood detection wndow is short some say 72 hours some say 2 weeks but it is shorter than urine. The metabolites are diluted by blood volume. In urine testing, the kidneys reconcentrate the metabolites and helps deposit the metabolites into the urine.
I don't know about the legal advice and your rights in this matter.

Also people remember there is a way to help beat these thugs at there own game. By law you get paid for the time you're going to get a drug test so milk it. Make that process just as expensive as you can. I use to love getting hit with the randoms because I would just go piss half the day away going to get my eandom. Go have lunch, go shoot some pool. You don't have to pee on command. It takes time.lol
If we make it cost companies lots of money they will quit doing it because thats all they care about is the money.

He fired me for refusing the test. Just filed unemployment claim and explained the them I have phobia of needles.

Bummer man. You will now have to argue your case to the Dept. of Labor in order to recieve benefits. I would simply tell them you passed a urine test the day before, and when asked to do a blood test, you can mention your fear of needles but also mention that you felt harassed by the employer, and that there is no drug policy in place that would allow for this kind of harassment. You might also explain that urine tests have the longest detection time, so a blood test would not prove anything if you passed the urine test, on top of your fear of needles. My under-educated opinion is that the situation is in your favor if there really is no drug abuse/testing policy, but I have never worked for a job that doesn't have one. If there is one, the employer had the right to fire you for not complying with the policy. Good luck man!

You know I've never had to deal with anything like this. I could have passed the blood test but screw that, its unfair and and unjust in my opinion. Its bad enough they can take our urine, but blood?? To me thats just pushing the envelope. Im not worried about the job, I was bored with it anyway....guess just needed this to happen to have motivation to find a new one.
I have a little spare time now, so whats a few emails to the ACLU or a few lawyers office's. After all slander did result in me being fired for no just cause :)
