Can they charge me with failing a drug screen 2x in a month?
Someone please help me with some answers, I'm pretty young, and don't have the money for a lawyer. When I checked into probation on July 5th, I tested positive for "thc". Now I checked in again on September 1st and I tested positive still. I am a small girl and they're saying I should be clean, however, I HAVE NOT SMOKED! I wish I would have at this point though. She is charging me twice within one month of failing a drug screen. Is there anything I can do?

Not a hell of a lot. You can start by eating a high fiber diet with metamucil and exercising to try and lower the thc levels. Have you ever had any kidney or liver problems? That could be why its taking a while. A lot of the probation officers still don't understand that it can take a couple months to get clean, they think it takes a couple days and it doesn't. Read up on the dillution sticky and follow that the morning of your next UA.

Sweetpea, I merged your two threads together. Please don't start near identical threads in the future.
What are you on probation for? Are you sure you haven't had any more pot since July 5th? You are pushing the edge of 60 days which most people will be clean at 60 days if not sooner.
If your charge carries jailtime, which it sounds like, in most states you are eligible for a public defender. If you can't get a good lawyer, at least get the public defender.
Hopefully, you have something more definitive than dipstick instant tests. Hopefully you have the two levels from the two tests and not just pass or fail. THC eliminates from the body following either zero or first order elimination (it slips my mind now but I htink it is first order). Either way the results can be graphed to show rate of elimination and show that you haven't introduced any additional THC since the first failed test. You may need a third test and soon and you may have to do it at your expense but if you were a heavy smoker or inactive or overweight (you say you are small so this doesn't apply) or a combo of these and others it may take up to 60 days to get clean.
If what you say is true and you haven't used since the first failed test, plotting the failed drug tests on a graph should show a line that follows either zero or first order elimination (whichever it is) and could be used to prove your innocence. However, if you think you can just march into a courtroom and pull out a few textbooks and visual aides to the judge and prove your point than you are extremely naive. You are going to need a lawyer to argue your side of the story.
