Did the defendant do this Act? If no, than the defendant must be found not guilty. Is this Act one of Public Danger? No, there is no Public Danger in not being an Exemption.

? = Is possession / delivery prohibited by the State? Yes, so the State does not have the right to possession or delivery, and the State does not have the right to violate TX penal code possession / delivery to get the evidence to the court room.

If the right is not given to the Federal government by the Constitution, nor prohibited by the State, then the power is given the State, if it is not given to the people.
