with my pal, visitin another friend at his college, i get pulled over just as i enter the campus by university police who tailgaited me a 1.2mi off campus downtown, out of their jurisdiction.

Said I was speeding up and slowin down at abnormal rates, although I stayed within the speed limit 25mph.. The lowest I went was 20mph. The highest 26mph.

stared into my eyes, talkin about glossiness, made up a story about smellin shit, searched the car and found a baggy with crumbs like no more than 0.2..

and so he cuffed me on unlawful posession.. now check it

i didnt tell'm i smoked, and i said i was fine and fully able to drive. so he tries to call in a DRE (Drug Recognition Expert), who was noowhere to be find.

asshole makes me do the field sobriety tests, which i asked lawyers and was told is mainly only to be done for alcohol..

along with that he adds the chemical tests, which included the breathalyze (0.0) and urine test (which thc can be detected up to 30 days usage)

this included walkin the line and keepin the feet out... now my knees, since i was pulled out of the car, were clanking together (it can be visible from any camera trust me)..

i told him i had received fractures and reconstructive surgery on both feet.. he told me i did great on the test but failed me..

i didnt fall off balance, and i did everything as directed (and when i got home, i researched the procedure to see for myself how he could have come to such conclusion)

he said i passed the horizontal gaze test, but handwrote on the report i had failed LOC.

The LOC test stands for Lack of Convergence-- a sub-sect of the "Nystagmus" horizontal gaze test in which they bring the object of focus closer to the nose, causing the patientâ??s eyes to cross.

It should be considered that there was also a major injury involving multiple fractures to and reconstructive surgery of the orbital (eye) region of the face, affecting functionality.

If oneâ??s told he/she passed the Nystagmus test, is it fair to add a sub-sect as an individual test on the report?

Also concerning the field tests it was mentioned prior to performance that both feet suffered prior fractures and reconstructive surgery. If medical documentation was provided for the nervous twitch and the feet injuries to support these defense claims, can a DWAI-drugs charge really stick?

Prosecution holds trace amounts of Less than 0.5g marijuana and a bag as evidence. A urine sample was collected. Thereâ??s no statement of admission & witness statements make no claim that the patient had consumed it.

Bullshit or not? What chances do I have of beating this? I kno I'm stuck with the UPM, but can I get this charged dropped? any advice??:(

you have questions that need to be answered by an Attorney, not us stoners :jointsmile:

simple enough you messed up by giving them consent.

For future involvements, deny any tests, do not give consent to search. They must have a search warrant or outstanding probable cause to search your vehicle. Some states nowadays have altered the laws where your motovehicle is an extension of your HOME and is to be treated as such.

There's a very minimal shot of you getting the charges dropped since at no point during the arrest did you refuse your consent to anything.

well i DID challenge the officer's request to step out of the vehicle and for that the officer complained of the smell coming from the car.

as for the tests, they presented the chemical tests first and indicated i could lose my license for a year by refusing that; as for the others i told them i was uncomfortable performing the physical tests.. it wasn't to my knowledge that the performance tests could be refused, but how it was worded with the officer led me to think i was fucked..
