MMJ Patients and Police Encounters

I am a MMJ patient. My friend is a patient as well. We are both on our first grows and are anxious to share out excess with each other. However, he is about a four hour drive north from me.

My city says that 1oz or less in my possession when being used medicinally is legal and they cannot detain me if I can provide sufficient evidence of my identity, which I can.

My question is this: When I get pulled over and the police officer suspects me of trafficking drugs (I plan for worst case scenario), do I tell him I have less than 1oz of medicine locked in my trunk and show him my recommendation or do I play as if it is still illegal and deny consent to search etc?

I assume that I can safely say that I don't have any illegal substances in my car because it isn't illegal for me to have lol

Do I trust my recommendation to hold up on the road? I know that in court it would, but I don't want it to get that far.

Any first hand experience with this would be swell, if not I'll let you guys know how my experience with it goes when it happens :jointsmile:

Don't keep it in more than one baggie. Even if it is under an o, they may charge you with trafficking.

I always deny consent to search. But that's me. Some people always do and just hide their shiz really well.

IF you're in California, and you are obviously NOT under the influence, you should be fine ... last year, the California Highway Patrol's Commandant issued a Press release, stating very clearly, and instructing his officers, 'that LEGITIMATE medical MJ patients would be released without citations, if pulled over with pot, and ALL cannabis is to be immediately returned to the driver, and sent on his way' ... if you were to be pulled over by a different kind of cop, and hassled, it may be to your advantage to request the presence of a CHP officer ... worth a try :thumbsup:

This is going to be a question that clearly reveals my status as living in a non-medical state. Are California medical MJ users (and those in other states that you know of) supposed to carry some sort of card that identifies them as such in case they're hassled by law enforcement for possession?

California provides the option for individual counties to issue their own Identification cards, but only a handful have done so ... their reasoning , 'if they issue cards, then they may face liability from the Feds' ... it's voluntary, and serves no purpose, except as a 'revenue generator' :wtf: ... a couple counties put high-$$$ price-tags on their I.D. cards, and activists got them to reduce it, as I understand ... I just carry a small Dr.-issued card, does the same thing, and costs nothing ... also, it doesn't put me on anyone's 'mailing list' ... :jointsmile: ... Merry Christmas, birdie :D

i have a question about medical marijuana- if you have a doctors recommendation, or a card with you....would you be allowed to possess weed on or around school grounds...perhaps if you are a college student, even if you are not smoking it on campus?

Here's the deal, if you are a legal patient, then keep everything in the trunk. DO NOT CONSENT to a search, DO NOT ANSWER ANY ?S. You are not doing anything wrong unless you have done some kind of traffic infraction. In which case you need to ask them "why did you stop me". They can lie, threaten you, do what ever they want. But you do not need to tell them anything. If you feel as though the cop is not going to just write you a ticket and send you on your way, then ask him, "AM I BEING DETAINED". You also do not have to tell them you are a patient, and it is illegal for them to ask you why you are a patient, or ask anything about your medical condition. (If you do tell them that you are a patient) Make the fuckers do their job. If they want to blow a couple hours messing with you and trying to get a warrant, in the end you will have the last laugh when and if they find your medicine, because they would have gone through all the trouble for nothing! Also keep your original rec with you but hidden, make a copy of it and if needed give that to them. I know first hand that some of those fuckers will actually take the original rec and make it "disappear". But if they make a copy disappear, then you can retain the original for court. You could also just get your doctor to issue you another one. Bottom line, I drive around hoping to be pulled over, just so I can piss them off. It's actually kind of fun, and so far to date, my record is spotless, and I have been pulled over a handful of times with no negative outcomes.
