Spent a night in jail

So last night i spent some time in jail. I got caught with less than .3 grams of weed and some paraphernalia. Which is well below the maxium amount for it to be a misdemeanor (8 ounces). It was the first time ive ever been charged with anything. I am 18 and have a clean record. Is there any reason i should be worried about jail time. The maximum is 1 year, its really bothering me. What is the chance that i will actually go to jail for something like this? I live in Kentucky. Also, the cop didn't read me my Miranda rights, will that play a role in the trial?

Its weird, I didn't have any anxiety at all really when i got arrested in front of like 10 families haha, and one guy came and thanked to the cop and gave me the evil eye, i just had to laugh at that. Even sitting in jail for 18 hours i didn't really think anything off it, i just thought shit happens. Now that i am free i just have this overwhelming anxiety that keeps building up. I just keep thinking oh god i might go to jail. It might just be my ocd, but i just cant help but think its possible.


On a lighter note my parents where cool with me smoking herb. My mom said if we lived in California i would probably have a card, which is true. She also said that alcohol is worse than weed in her opinion. My dad also gave me support saying that this country has its issues, and that something like this is a bit ridiculous.

i got caught with a small ass bowl, spent one night in jail, got my liscense suspended for 6 months (Which i didn't even have) had to pay over 1,000 in fines, and to get my liscense i have to pay a resinstatement fee, take a drug program, and pay 'high risk' insurance...

i wouldn't really worry about jail time.... be more worried about everything else you're going to get stuck with.

mention that to your lawyer that the cops didnt read you your rights. I hope you didnt give him consent to search.

i dont think you need to worry about any jail time. .3 grams of weed? how the fuck did they find that? you'll probably just end up with 1/2-1 1/2 years of probation and maybe some community service. since you're 18 DONT violate probation because they'll throw your ass in jail for that. my buddy just got busted with 2 oz and is lookin at a maximum of 8 years, but i know a guy who had 5 lbs in his car, got busted, and didnt do any time.

i didn't give him consent. i of course had bottle rockets in my car that i had left there since last july. He asked to search and i said no, he said that the bottle rockets were illegal and that he had the right too. He didnt have to find it cause when he made me go to my hood and wait, i just told him where it was, cause he was going to search my car regardless. It wasnt hidden at all considering i just got to my car and was about to leave when he showed up out of no where. I have to cross my fingers that my parents have a good lawyer. A friend of mine got caught with weed and just had to do 10 weeks of drug classes.

after hearing all these stories, i feel really bad for you guys. I live in california (dont have a card) and the cops found like 2 grams on me and the cops just made me throw it away and they were really chill about it. I've heard other stories like this from kids at my school. Maybe its california, or just my city's police. But getting caught with a bowl of weed and going to jail for a night AND getting your license suspended is total bullshit. thats just not legit

I paid about a 500 fine and had UNsupervised probation for 8 months. This was my first run in with the law and they said if i didnt get introuble while i was on Unsupervised probation it would be wiped from my record. I also live in Texas which has horrible MJ laws. They don't have to "Mirandize" everyone, only folks they detain or take into custody whom they're about to ask questions of relating to the commission of crimes. This is a popular misconception that everyone has to be read his Miranda rights, and everyone doesn't. In this case, you weren't questioned. You were caught with weed and paraphernalia and arrested and booked on those charges. If they caught you and thought you'd robbed someplace or committed a murder and needed to hold you and ask you questions about those suspected crimes, then they'd have had to Mirandize you. But in this case, they didn't.

im glad i live in a country where cops are corrupt... so if they bust you, just give them like R$50 (about US$ 20) and they will let you go as if nothing has happened... but of course they will keep your weed, probably to smoke later...

i wish you could just pay cops here... well for something like that... i'm sure that also eventually leads to more dangerous things, such as killers and rapists payin the cops of to be let go... but it would be nice to be pulled over with weed and all you had to do would be wave a 20 in their face and be on your way.

Damn, have gotten pulled over and had weed taken a few times, one time with a few grams of white taken from the Narc Task Force, one time with my friend drunk driving...nothing. Not to mention the times on foot. Saw a guy get an ounce taken from him the other day from the cops (no charge or anything)...wow. In New England where marijuana is not decriminalized yet.

lol it has little to do with having nothing to do... first, prison systems are a MAJOR 'industry' in texas.... and they make money on every prisoner (i think they get paid liek 200-300 a day per head.. it costs less than 20 per day to keep them there) and then of course... texas is a mostly republican state... always want the harshest punishments for the most minimal crimes... it doesn't work both ways tho.. my brother was murdered, and the dude got 2 years in prison... he murdered my brother, and admitted to doing it, with a shotgun at close range... for no real reason... just a disagreement i'm guessing....

ain't the only fucked up thing i've heard coming from our judicial system....

i wouldnt be worried about ur trial, it will prolly be nothing more than you telling the judge your name and him/her either dismissing it alltogether or telling you to pay a fine. nothin serious.

in my experince court was wayy too anticlimactic after a funfilled day in bookings

GL, Mafyew, I'm in TX, but never been hauled in. I hope ya get as llittle of a headache out of this as popssible.

Slip-- no shit, I remember when they first started the no smoking places and how ridiculous it seemed. Now it does seem kind of normal. Whats it been, at least a dozen yrs or so since that 1st started? And yeah, now w the hospitals... I understand not wanting people to smoke right outside the door, but wtf, at least give smokers an area and not ban it from the property entirely.
