I'm going to be applying for a job that does drug screens. On the applications I have it asks if I have tested positive on previous drug tests. If you say no when the answer is yes, can they find out your lying?

If someone fails a drug test is this information available to other employers via background checks?

I think drug testing information is confidential.

I know that at my school they aren't even allowed to tell my teachers that I've failed my drug tests, and it won't go on my permanent record.

Absolutely confidential. It's private medical information and you would easily be able to sue if the information was ever released!

Unless of course it's between government agencies.

If it is a DOT job and you have failed a previous drug test for a DOT employer, then I believe they share those records for a certain length of time. I'm not sure how long.

This is true. When you apply for a job at another company you will sign a document authorizing your old employer to release drug test information to your new employer.The way around this is don't list an employer that you have ever tested positive for.

^Are you sure about that? I was reading on a trucking forum that if you fail a drug test they put it on some other record that follows you like a credit report. I forget what it is called, and being a trucker I probably should know about this report, but it basically is a history of your work other trucking companies can check out, and failing a drug test is supposed to be a good way to screw up that report.

Also, if both the company you are applying for, and the one you failed a drug test for use the same testing company, wouldn't the new company find out that way?

This is if they contract with a company called DAC. They may of changed there name. I think I read that somewhere.
You will know if they use one of these companies because you will sign a document authorizing that company to release that medical information.

Only if you sign a release form authorizing that info to be released. Thats why if you got nailed with a positive do not lisst that company on your job application.

hmm...interesting...just wondering in case of the horrible event I might fail someday :) But I think I would have to be honest if I did anyway because otherwise I'd have to explain why I wasn't employed for 4 years...and plus a lot of trucking companies require you to have driven recently...so..yea. But I haven't failed yet so this is some good information for future reference :)
