View Full Version : Legal shit..lil bro suspended for dirty urin..

So my little brother (now 15) got kicked out of school for many failed urin screens. This was probably about 2 or 3 months ago. Our school told him he had to complete a 30 day rehab program to come back to school. He completed exactly 2 weeks until he got kicked out for fighting. The school said after he had to follow up with a doctor and get another urin screen and checkup. If he fails the urin screen he can't return until he passes or something like that..he's only been clean for 14 days though, BUT his levels have dropped incredibly (He was originally at 850 now t after getting tested today, they're at 200). He says LEGALLY if his levels are higher then 400 he can be suspended but if not he can NOT be held out of school. His mom says they're going to bring a lawyer with them for his next IEP meeting on monday to fight in his defence basically saying, you can suspend him but you can't expell him and that they want him back in school. BUT because he didn't complete the rehab will the lawyer even work?

i hate schools though. not even hate, <u>detest</u>. its like they really do have this secret agenda to fuck up the lives of kids who like to have a good time.
the idea of mandatory schooling in todays schools (americas at least) fucks with my head. how can they do that to kids, i know school fucks me up in the head. badly. and im not even bad off at all, i have alot of friends and i have easy classes. i cant imagine how it is for the kids with no friends. its inhumane, because kids can be so fucking creul.
well now that i typed way more then i planned on typing, i think ill just go with a
poof!

we both go to alternative school, which was cool when we were together all day. it was fun, but they fucked up his life badly but basically calling him a drug addict and drug testing him then not too long ago they tried to pull the same shit with me and I FLIPPED a shit. They REALLY fucked up his life, before he had all this free time he was just a lil pothead, then he got into hard shit (which hes pretty much done with now, luckily)

his levels were over 400 at one point, and he didnt finish rehab, it really depends on your school. The lawyer might work, but theres too much evidence is against your bro.

ahhh yes youre lucky it was just a bout with the hard stuff. that sucks about the whole testing thing, i dont hear much abotu it here in canada, but that sounds pretty nazi if you ask me. Id say the lawyer is definately worth a shot, schools tend to back down in the face of a higher authority.

What are you, fucking 12? A certain amount of school is required to prove you aren't a lazy sack of shit. If you can't deal with that for 12 years simply because you're a burn out, then I doubt you're going very far at all.

A lawyer will make a heck of a difference... The school is now put in the position of crossing their t's and doting their i's... The school would be less apt to fight a lawyer and it means they now have to involve their lawyers...
Bottom line is Bro has got to stay clean for the tests in the future!!!

try fighting against the urin screens in whole rather then just his specific case. Jump on the privacy issue and ride it hard. Thats what I would do if I was a lawyer and had a client who made an agreement to complete rehab in order to return. If they had failed to complete rehab.Your better off to have the lawyer go that route because the student broke an agreement so the lawyer can't do shit about them keeping him out, unless he completes the rehab and they say he still can't come back. A lawyer would win in that case :)

Look at your County/State BOE Ordinances. Schools are drug free zone areas,and in most cases they can keep any student with drug issues off their campus, the exception are the alternative schools for troubled kids,its why they are there.
Also you have to look at the papers you signed when you first signed up for said school, most people dont even read the entire document.

It doesn't seem like they can deny someone an education because of what they do in their free time. If they aren't partying at school, what is the problem? Is he on some kind of disciplinary probation or something? I'm sure a lawyer could help but it sucks to have to spend the money. Good luck.
