my girlfriend in united state just got busted for 3 plants. what do you all think the penalty will be?

Depends on state, but 3 plants, she'll be able to plead down to a short probation.
If she got caught selling, it's another story.
I hope she finds a good attorney.

HAve her talk to her lawyer about pretrial probation or continued without a finding... after probation period, charges are dismissed... looks better on your record.

she lives in north carolina, i'll arrive there tommorrow, so i can at least bail her out. thanks a lot for the help though. any other suggestions or anything?

and she didn't get caught selling, they were only a few weeks old too. does anyone know how much the bail might be for this case? also what is the without a finding and all that other stuff. we use totally different laws down here.

Was she within 1000 feet of a school or daycare? In my state that there alone will get you 2 years MMS. Check out her state laws here (http://www.norml.org/index.cfm?Group_ID=4516). I wish your girl the best of luck.

well thats the thing she wasn't at all. but yah i read if you've distributed in that area than you will get in big trouble. but the thing is they were small tiny plants. couldn't even be distributed. but they are trying to call it with intent to sell. how does that work? can we fight that. sorry for my lack of knowledge in these laws, i never have been in the states long enough to know.

CWOF means in my state (it's a commonwealth as I think SC is) that you admit that the state has enough evidence against you to convict, but you would rather not go to trial, and you are asking the judge to accept your apology for your fuckup and be on probation for a year without a guilty plea.

She needs a lawyer, no way around it if she wants to walk on this. Three plants are nothing much to be concerned about. They always charge the highest they can come up with so there'll be a better chance the defendant will plea bargain and it won't even go to court. if this is her first offense most likely she'll end up with simple misdemeaner possession and possibly probation but I would expect her to not receive any more time than what has already been served.

Get a lawyer.

well i talked to her and basically, she got manufacturing (first felony) and than maintaining a dwelling for controlled substances (2nd felony). i'm going to get a good lawyer but just wondering if anybody knows anything about these charges. a thanks to everyone helping me out.

this is no laughing matter...it is going to depend a WHOLE lot on what else was taken as evidence and her statement to police

another thing how in the hell do you get busted with three tiny plants anyway?

#1 hire a GOOD attorney 2 felonys 5-10 thousand to beat the charge...any lawyer will take the case but defianately find out who the man is in that town. there is always 1 lawyer who beats everything.

the judge doesn't care how measly the plants were especially general sessions. all he cares about is she is charged w two felonys.

#2 if its a small town get a word in to the da (this helps more than anything)

#3 money talks either pay a big lawyer or pay big fines and court costs its simply your choice.

they will not offer any kind of slap on the wrist in the south for any type of drug charge.. not even roaches....they want your $$$$$$$$$$$$

TN has a sales tax on all drugs (thanks to bonaroo) they made 2 million on taxes from seizures at last years festival....

you also might want to check with NORML if i remember they have lawyers that specialize in these type of cases. worth looking into

all you have tyo do to know laws is look up norml...NC has decriminalized pot, which means that she gets slap on the wrist basically...might have to buy TAX stamps, but only 3 plants are under any major crime limit. LIke I said, "you can read about any states pot laws, by go to norml website.

it's the most retarded story how she got caught. there are some window workers at her apartment. the apartment didnt' give any notice so she didn't move them or anything. but when she realized they were coming before work she turned off the light and put some blankets in front of the door (she had to move a lot of stuff out of the way because of windows anyway). that night her roomates room had magazines thrown everywhere and they stole the roomates bowl. the next morning police roll up. cocksuckers.

yea you will definitely need a lawyer. i didnt get busted growing but was arrested with 4 oz's about 2 years ago. i payed about 5000 for my lawyer and i walked away just doing a few drug rehab classes for the court. her charges CAN be beat and completely expunged IF you have the money for a good attorney. good luck
