contact ebay, show them proof you paid, and tell them he never sent your package... should get your money back i think? if not go through paypal, tell them you bought something off ebay and the guy isn't sending what you ordered... and ask them if they can transfer the funds back...
if you do end up fucked in the end, let this be a lesson to only use people who have really good ebay reputation (i forgot what it's called lol but there's something to show how well of a reputation they got going.)

you will end up getting your money back even if it means gettinng legal advice if you do have to go through legal shit just go to one of that ones where they claim their fees off of the person that screwed you over

Go through PayPal....I used to sell on Ebay and actually I got scammed a few times as a seller...It is amazing what people will do to rip you off but basically from my experience if the seller does not have absolute proof of shipment Pay Pal will refund your money.
I had this happen a few times with items that did not cost much, so I shipped them cheaply, no tracking number, and in every case PayPal refunded their money. I even had a case when a buyer refused shipment on an item that cost me $60 to ship, He filed a complaint with Paypal saying he did not want the item, I was ok with a refund as I had the item back less my costs for shipping it....PayPal didn't see it that way and refunded him all his money.
As you can see I am not keen on PayPal as a seller as they seem to protect the buyer more........If you can prove you paid and the seller can't prove you received the item, you should get a refund....It may take a few weeks though.
Good Luck.

And if Paypal wants to be pissy, file a chargeback on this purchase with your credit card company.(I assume you paid via a credit card and NOT the paypal wire transfer.)If you used your credit card thru paypal, you can get your money back via a chargeback on the CC.Of course if you do it this way, Paypal will threaten to close your account.(you can get away with it once, do it twice and they WILL freeze your account.)But paypal sucks donkey dick anyway. The fucking company is owned wholly by Ebay and we all know Ebay's nickname "FEEPAY"

good advice... i would def try to settle it with paypal first... You may need ebay one day for fast cash so tread lightly and don't be impatient as long as PayPal is cooperating...
