View Full Version : **WHAT ARE MY RIGHTS!?**

If I get pulled over and I have weed in my car, I heard that I can put it in my shoe and if the cop asks if he can search me i have to let him, but not my shoe because its classified as a strip search in which they will not have a warrant to perform. Plus, if you have a passenger in the car, you can give them the pipe and weed and they put it in their pocket. Passengers have the right to refuse giving identification and refuse a search. The cop could ask "Can I search you?" This is a question to the passenger: YOU CAN SAY NO! They will then ask you if you'll at least empty your pockets in which you leave your pipe and weed in when taking other stuff out. If they see a buldge and ask what it is, (if you're not hesitant) and you can just say its your cell phone or something like that and they cant do SHIT. Does anyone else know any really cool and important facts like this all us stoners should know?
that isnt really a cool an important fact so much as it is common knowledge. and the first thing you say contradicts with the second. if they ask you can say no, and they cant search your car. yes thats right if they dont have pc they cant search your car, that doesnt just go for strip searches. if they have probable casue or a warrant then they probably wont ask, theyll tell.

follow this link and watch the video this will explain things a lil more clearly but unless you have broken a law you can refuse to give them consent to search and if you do this and they find anything your attorney can file a motion to supress which means any evidence obtained in said search is inaddmisable http://stopthedrugwar.org/videos/busted you can also find out more about penaltys for possesion at norml,s web page they have a listing for each state

You have the right not to incriminate yourself, you have the right to remain silent. Coppers hardly ever go for the socks ;)

idk about any of that shit.. cops around here are searchin you if they want to. What you dont understand is they are not idiots, they are specifically trained to deal with the situation, and have ways to "trick" people into incrimination, thats what they gotta do. As long as you dont give him any evidence he cant do anything. No red eyes, nothing he can see, no weed or smoke smell, etc.. always have the story straight too, thats the most important thing to know. Cops roll up on kids smoking and the cops first question will always be what are you doing here.. if you cant give him a good answer he has a right to search you.

Yeah, and Rodney King could'da just asked them to stop beating on him with the sticks ;)
If you're carrying weed and you're caught with it, assume that you're fucked! I've been to the states a few times and lived there for 2 years in NYC and never once smoked while over there. Those US cops just don't seem to have a sense of humour!

Okay guys you really need to know your rights for those of you who are in america. You could be high as shit and they have no right to search your car. Cop asks "Sir have you been smoking illegal substances?" It is simple all you have to say is no. They ask you if the can search the car. You should say no officer I do not concent to any searches. And if they search anyway that is illegal.

but there is also probable cause and the fact that a cops job is to get you into inrcriminating yourself. Even though people here somehow find security behind thinking that they can just deny searches whenever they want to.. the cops are all prepared for it and how to react to it. For example, if a cop really thinks you are high and wants to do something about it he can do a field test, proove you are high, and then search your car for the evidence. I would just avoid smoking in cars unless you absolutely have to, thats the only way people get busted.

Under the United States of America constitution you are protected by Amedment 4. "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized." In other words if there is no search warrent they have no right to search you must give concent to any searches. Exercise your rights Americans!!!!!

Removing the shoe to check if anything is inside is a common practice, and is not considered a strip search...whoever told you that needs a thump to the head, about being high as shit and you the above poster saying they cant search your car.....think again...its cause Reasonable Suspsicion, gives cops everyright to search your car. Ever heard of Suspicion of DuI?
