I heard that in Texas a cop MUST find a pipe or some kind of paraphernalia to formally arrest you for smoking. So even if you're stoned off your ass and the cop knows it, all he can do is detain you if he finds no weed.

Anyone know if this is true or a bunch of BS?

true, you can go sit at the courthouse and be stoned as hell but if you have no pot and no parifinali what so ever you can be detained for 24 hours thats it

do u mean that if u had weed but no pipe or ne smokin device then u wouldent get fucked? nah ud still get possesion of a conrtolled substance and depending on ur age and amount u have most likley have some sort of jail time im guessing... i live around the houston area and knwo some guys that have gotten caught and they got fucked big time

isnt it like that anywhere? if you are high they cant do anything unless they find something, right? or can they drug test you if they had reason to believe you were using?

My understanding is that even with test results, if a cop finds no actual weed on you or paraphernalia they can't arrest you. Just detain you.

I was just curious if anyone actually knew for a fact if this was true or not... I had a close call a while back and was curious how close I was to getting in a lot of trouble.

If they don't find anything on you they can't arrest you for possesion. But, if you are driving when you are caught and your driving was fucked up, and the cop thinks you are stoned, he might try and charge you with dui. You can get dui for being sleep deprived, or even if you are talking on the phone and you get in an accident(in texas that is, i'm not sure about anywhere else).
