View Full Version : What do you think will happen to me?
Last night, me and two of my friends were driving around smoking a blunt at about 3 AM. Well, we were driving on the dirt roads, and we passed a cop, and he started following us. I started eating the blunt because we were in my friends car, and he's been in trouble for numerous things.
So sure enough, he pulls us over. He pulls my friend (the driver) out first and then me. He tells me that my friend had dope on him and asked me where mine was. I told him I didn't have any. (My friend didn't have dope though, he had a couple flakes on his shirt, and that's what the cop found on me too.)
So he cuffed and searched me, and I had nothing except those flakes.
So, long story short, me and my friend got taken down to the station and I got put in a holding cell, then I got my picture taken and fingerprinted, and then they eventually let me go.
They didn't give me a ticket or nothing, and my friends who've been in trouble before (This was my first time being arrested.) My friends who been in trouble before are saying they don't think I'm going to be in trouble for anything and they let me go.
Does anyone know what will happen? If I have to go to court, I'm definitely gonna fight this because I know they won't keep a couple little flakes as evidence.
So anyway, anyone been in a similar situation? What do you think will happen?

He didn't give you a ticket or fine, so there is no write up for you to come in and appear in court. You usually go to court when they issue you a ticket, and it says on the ticket when, and what time, but seeing as that you didn't get one, no court date.
Sounds like you got off lucky. He probably processed you guys just to get you shaking a bit, hoping that that arrest would smarten you up.
But no ticket, no fine means no court date, and it's more than likely not going to go on your permanent record or anything that would get you in trouble in the future.

You can get charged for a single flake of marijuana, but chances are you won't. Besides, they're legally obligated to tell you what you're being charged with when you're being arrested. Lastly, your friend having dope is not probable cause to search you. Did you give him consent to search? Even if they say things like "Make this easy on yourself and let me search", it's total bull. Never co-operate unless you have no other choice. "If you have nothing to hide, you don't mind if I look, right" Implies that you will be considered guilty if you don't let them search. Also bull.
Either way, from your story, it DEFINATELY sounds like you got off. Hell if you had a lawyer you could probably sue for false imprisonment.
If you do go to court, you'll end up paying like a 40$ fine or do 10 hours community service. You won't do any time, that's for damned sure, especially if this is your first drug related offense, which given your confusion, I assume it it.
For the record, I've been arrested for drugs twice and have done insane amounts of research of the legal system/
Yeah, that was my first time being arrested for anything.
They did fingerprint me and the cop said something was "all part of the booking process." So I don't know if I should expect anything.
I hope you guys are right though, and that nothing will happen.
I heard that I could still get a ticket in the mail telling me about a court date?

It's possible, either way, nothing to worry about. Did you give consent or not? If not, fight that shit. Tell your lawyer/defender you want to file a motion to supress all evidence. It's worked for me before. If you DID give consent, and they charge you, just take the charge man, it's just a crappy misdemeanor charge that you're going to get slapped on the wrist for.
The reason they told you you might be getting a subpoena in the mail is because they have to turn the case over to the DA and see if they want to prosecute. Chances are, they won't, but that's not guaranteed.
Either way may, just chalk it up to a learning experience and be smarter next time.

Well, I didn't give consent, but my friend who was driving had a felony warrant out for his arrest because of his second offense possession. So I guess they had reasonable doubt.
They didn't personally tell me I could get something in the mail, but my friends and stuff have told me I might get something.

you definitely can not get charged wth a couple flakes of marijuana. They need enough to test, AND enough to submit as evidence in court. Thats why they let you go, they didnt have shit.

Yeah I did. One paper said what they found on me, and I don't know what the other one said I kinda skimmed it. Very dumb of me. That's the only thing I'm worried about.
Meh, I don't think that's what it was. I know the first paper just said what they took from me, my cell phone, wallet, etc.
I have a clean record, and I'm thinking they won't even prosecute me.
If so, I'll try to get some sort of settlement by pleading no contest or something. Someone can probably help me out here, as I'm not too sure about what those options could mean.

dude... i dont know what to tell u all i can say is "cops are ass holes" me my gf deb, and my homie daniel were all walking down this street in darrington... well... on this street we were walking down there happend to be no side walks.... well... this night there just happened to be a cock sucker cop on patrol and we were about to turn down the street to go smoke a few bowls... well.. the cop pulls up behind us... and we start trying to get towards the side of the road(this road is barley wide enuf for 2 cars to pass by each other... and theres no side walks...) well... he rolls down his window and says get off the road your J walking... and i said "were the hell am i sapost to walk... well theres old man reesces house(darrington is a very small town) if i rember right, old man resce threatnd to shoot my dog when it walked across the corner of his yard..." he slams his car in to park... gets out and starts yhelling whats your names... how old are u whens your DOB... well... daniel said something like what the fuck man... so he gets thorwn in the back... and then deb misunder stood his question... and got thrown in the back of the car... so they got disorderly conduct but said nothing about the jay walking tickets... so FUCK PIGS.... the fucking cop i had to deal with last night... must of had a tinny dick or got picked on alot in school
Even if I signed something that said what I was being charged with, there is still a chance nothing will happen, right?

Unless it was a signed CONFESSION, you have nothing to worry about regarding the paperwork. Yes, you sign one paper confirming your personal articles that are being held for you, and another one stating you have no intentions of attempting suicide.
Just because they did not charge you right away doesn't mean they still won't, but it's unlikely. Few flakes, they probably thoroughly searched your clothes and car hoping to find more, but worse case scenario you pay a fine. Good move on eating the blunt. I wouldn't worry about it too much, you've made it through the worst part.

Even after the chief of police told me TO MY FACE that was NOT going to be charged with anything back in 8th. I wish you luck, my friend. The worst that they'd probably do though is put you on some sort of probation for most likely less than a year.

Yeah, that's the statute of limitations. It varies from state to state, and most notably from charge to charge. I'm not even sure there is one for felonies (murders, child molestation etc) or if so, it is very long. People have gone down for that stuff decades after. Much shorter for "victimless" crimes, but as you discovered in your state (along with the fact that cops lie), statute of limitations (for whatever you did... posession?) was at least two years.
