Entrapment Laws and the Internet

Im curious to know wheter some one ask to buy Marijuana from you over the internet and then you meet in real life and sell to them if this would be considered entrapment? Part of the definition for entrapment is that if it leaves any possibility of the person not planning on committing the crime until solicited then it is entrapment(in this case over the internet). So Im making the assumption that you could sell to people that you have met over the internet as long as you leave traces of being unsure so it would fall under entrapment?

Anyone else have any ideas?

Before you do anything, smoke the person out. A cop can't break the law during an investigation. If they decline, "Ahhh, I just smoked.....No thanks....etc.", I wouldn't have any further discussions. Ideally, you'd want to do that before meeting to make the deal. This way, if it really is a cop, you go down for a joint VS. going down for a joint AND some herb.

The Old Bill would have to be pretty desperate to come on here and entice minor smokers into a bust, if its a problem surely a disclaimer could be put on entrance to the boards.

I'd imagine there is a good load of police here...smokers and nonsmokers. I'd imagine the smokers probably wouldn't be the ones trying to bust people. That would just be, foul.

I live in Canada, and here they take your weed and tell you to leave. If they don't issue a ticket (99% seriously don't) than what else are they doing with the weed?

Entrapment is a concept really hard to prove. Example would be some undercover cop woman asking you to get some weed, and you were hesitant to do it, then they offered you a blowjob to do it. That's entrapment. You might not do any drugs at all, but an offer for a blowjob would entice a lot of people to do something they normally wouldn't do.

Ive seen cops countless times in atlanta trying to catch mufukas. They say shit really vague so they can twist it around to make it work in court.

I would venture to say that one could get extremely rich off a fool proof way of moving shit over the net.

Alot of these "fuck the police if they are watching I only have a joint ppl" take for granted that some people on here may have more than a joint. I couldnt imagine fuckin with anybody off the net. Thats a real grey area. I aint talkin bout the spot in amsterdam either.

Undercover cops arent allowed to commit FELONIES, getting high or smoking a crack rock to bust you or your supplier, they will do. Entrapment is just some1 making you do something you wouldnt wana do. Say some1 wanted to buy pot from you over the internet, IF you go and meet them, your busted dude.

The real answer is that entrapment occurs when the government actor originates a criminal design, implants in an innocent person's mind the disposition to commit a criminal act, and then induces commission of the crime so that the government may prosecute. If all these elements exist--and you can convince a judge or jury that they do, then you can defend yourself with an entrapment defense. Good luck. :thumbsup:

I think (this is opinion, not fact) That being the law is on an officer's side, they can pretty much do what they want to bring the person in, be it by the book, like I'm sure (hope) most officers do, or whatever way they see fit, and then make up the rest to make it fit.

In the eyes of the court/law, the officer is the person they're going to side with, unless you've got hard evidence that says otherwise.

Its not entrapment, period. Popos can and will do anything and everything to take you down. If you can, run. Whats worse, felony flee or poss. w/int. to sell? If you cant run, bribe with what ever you have. Most cops are criminals themselves. What are they going to do add a bribe charge to the growing list of drug charges. Last time I got poped, I had somewhere between $600 and $900 in my wallet. They came and got me and yanked my wallet real fast. The money never showed up on the seized list. I made this statement about run or bribe on this board before so I guess they were ready this time, they just helped themselves and took me to the pokey. Sure you can buy weed online... and even have it mailed. Is it "safe", not really. But imo you run similar risks buying on the street, unless ur lucky enuff to have someone you trust to deliver etc. But even then, ive known long time "friends" to roll on each other in rough times.

When dealing with "illegal" substances, nothing is 100% safe.
