Last night I was sitting at home wondering why my little brother, who's 17, hadn't come home yet, since it was after his midnight curfew and he doesn't usually break it. My father was at work and my mother was sleeping. At 1:30 I started getting really scared that he got into a car accident or something, so I called the local police station. They told me that he was in their custody but wouldn't tell me what happened. I went down there with my mother and found out how fucked he is. Apparently he and his friends were blazing and drinking fourties by a pond one town over. Afterwards my brother was driving them home and made it halfway there before a cop saw him turn onto a street and accelerate very slowly and stay at 10 mph in a 30 mph zone. The cop followed him for about half a mile before lighting him up and ordering him to drive into a parking lot. They came up to his window and smelled alcohol and weed. They found pipes in the back seat and 40 ounce malt liquor in the trunk. He failed field sobriety tests so they arrested him. Now he's being charged with Driving While Intoxicated, Driving While Ability Impaired By Drugs, and Driving to Slow. He admitted everything to the cops. They said that they might give him a break if he rats out some dealers, but I don't think he wants to do that. Now he has to appear in the same court where he was just convicted of underage drinking a few weeks ago. This is also his fourth arrest since March. I don't know what to do about this kid anymore.

I don't know about that. We have a good lawyer and the judge in our town is a good guy. I'm really not sure how this will play out.

Well if your lawyer gets your brother out of this mess then good for him. But if your brother DOES have to do some time then he will learn from the experience and not fuck up anymore :)

4 TIMES in like 5 months....no lawyer is that good....for one...there is the 3 strike rule...at the least amount of time surved...he will do the 120 day shock sentance...TO SCARE THE LIVING SHIT OUT OF HIS DUMB ASS..now...as far as him confessing every thing...well...his lawyer will have no way of getting him out of the drugs...the alcohol...well....out of everything...tell your brother your goodbye's and give him a shit load of socks...he will go to jail...i would say honestly...5-10 years.....but hope and pray for the 120 day shock..

Well first off, he made out pretty well from the first 3 arrests. Our lawyer got a Criminal Tresspass from the first arrest, and a Criminal Possession of Marijuana from the second arrest, dropped in exchange for him pleading guilty to Disorderly Conduct, which is just a violation. The third arrest was for underage drinking, and he was sentenced to watch a 20 minute video and write an essay. I realize he's facing some serious charges, but I think jail is unlikely. 5-10 years is not possible cause the maximum penalty for each charge is 1 year. His arraignment is tomorrow. I'll let you know how it goes.

Damn, thats fucked up. Well he shouldnt have confessed. If I was already in trouble I wouldnt have said shit :p. I hope he does alright though.

i hope your joking because if not you dont know what the fuck your talking about. hes goin to real jail cuz hes 17. Not even 120 days if that then that should be max.

Don't worry Euphoric, he won't be ratting anyone out. He's not going to jail. He went to his arraignment and the judge talked to him for a long time about how he needs to find new friends and be more productive with his time. This judge is a really good guy and basically mentored him during his arraignment. He also referred him for evaluation for a program called TASC, or Treatment Alternative for Safe Communities. It is essentially a program to provide counseling and treatment for non-violent law breakers as an alternative to jail. The DWI charge is most likely going to be reduced to a violation charge of Driving While Ability Impaired by Alcohol, because his BAC was only .05%. The Driving While Ability Impaired by Drugs is dependent on the results of a drug test given at the police station, so that could get dropped depending on the THC levels. Our lawyer says he'll probably get probation, community service, mandatory counseling, regular drug tests, and a 1 year license revocation.

Man I don't want nothing bad for you or for your brother but come on...that's too many times.
If I was facing those charges or if I was arrested just once I would change my atittude but your brother is still the same or even worse you should talk to the judge so he gives him a hard time like comunitty work or a couple of months in jail so he can open his eyes and then he'll be more mature...
damn ur brother seems to be lacking some common sence.... but i feel sry for him :(
hope the lawyer is good and the judge is nice :thumbsup:

That sucks man i hope it isn't to harsh but it's gotta be something to knock some sense into him because he's still technically not an adult until 18 and after that he will get fucked over 10 times harder. Watch him and make sure that if it keeps happening he gets help. When i was 15 is was caught over 5 times for DWI and driving without a license and I was never punish hard enough for it to help me but after I went to prison for attempted murder and a bunch of other shit I had my eyes knocked open and I got out of the gangs and I made something of myself. I hope he learns before he gets to the point where I was, I wish i did.

shit man that sucks for him...
if the police want him to rat out dealers, then you should rat out dealers who have skimped you or have been shitty to you.

DO NOT fucking rat on anyone!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!i lost 5 years of my life due to rats.he will not get much time if any.he is 17 and it is possesion.that equals probation to 60 days in county.woopy fucking dooo.if he can't do a few in jail then he needs to quit doing anything illegal.if he rats on ANYONE than i hope whoever it is kills him.that may sound drastic but if you cant do the time dont do the crime.........heard that b4???

He's not ratting on anyone. His attorney said it probably won't help him out anyway. Even if it did, he's not willing to do it, even to save his own ass. He's not going to turn against the people who've hooked him up the last few years. He's not facing possession charges. They didn't find any weed, just pipes, and the cops figure the pipes belong to the kid in the back seat, although he didn't get charged for them either. They found alcohol, but they didn't bother charging him with that either. He was charged with Driving While Intoxicated and Driving While Ability Impaired by Drugs, but he'll most likely be able to get those charges reduced.

good.VERY minor charges.he may lose his liscence a while but that is better than feeling like a bitch for the rest of his life.that is my opinion and every other mans as well.i am very glad to hear that your brother is a MAN.....much respect to him.
