So i may have a felony charge against me

this shit is really freaking me out.

And i am unsure what i should do, and i am looking for options.

Okay first off it start when a friend of mine (who ill call Tim) and I where gonna put in 40$ to get a nice little 1/4. well right when i get to my dealers house and everything seems fine right from the beginning. i get back to the car where my friend was waiting, i gave him his share of weed. but he never touch the weed nor the altoids case where i put it in.

And well everything is all handy dandy and he drive me to my house and not even 2 sec before i get outta the car, a undercover cop's pulls behind me along with 2 other cops.

to make this story shorter, they never found the weed on me(witch was half of the whole bag), but they did find his weed inside his car, and now the cops is explaining that i got a felony charge for delivering.

i been talking to a friend who said "well if they never really see you hand it to him, they can;t prove it. well while they found the weed in the case my dumb ass friend hid the case under the sit, and tried giving me the 100% blame (witch BTW isn't a friend no more).

so to sum this bitch up, i dunno what i should do. If i should just say it's all mine or try to fight it. the only problem is i dunno if i say it's mine when i get into the court well they believe it.

Sounds like you have a decent case. Hope you didn't talk much to the cops. Get a decent lawyer and you should be fine.

i am just repeating that the cop said to me. he Say's felony for delivering.

i think that's because it's almost another way for selling, so what ever i do i still get screwed

You need to lawyer up and make sure you repeat everything you said to the cops to the lawyer. If you have no previous record, things can usually be worked out. Then again, I don't know how stuff or leniant Michigan is with drugs.

A little advice for you and everybody else.

Know and exercise your rights - The only thing you have to give Leo is your identification. Never give him anything else. This means do not answer questions, do not give concent to search or any thing else for that matter. Do not give him a hard time. Do not resist in any way. Do not, panic remain calm and take a none defensive plane tone. Do not smile, laugh or in any way make jest. Practice and use the following statements and questions only;

Can I go now?
I want a lawyer.
I will not answer questons with out a lawyer.
Am I free to go?

Be prepared and aware that Leo is going to go off on you like a red headed stepchild. He is not going to be happy and he will go to illegal lengths to get you to breakdown and cooperate. You may even get your ass kicked. Whatever happens stay the path and let a lawyer handle it. Do your best to remember officer names and rank. If you do get abused, when you post bail or are released go strait to the ER get treated and make sure the Dr. records your injuries, get photo's.

I guarantee it will be dropped to a simple possession charge once you
go to court. Nothing to worry about on the felony charge unless
this so called friend made a written statement that you were the
one that got the weed for him, still a quarter ounce I don't see
why the DA won't drop this to a simple possession charge no matter
what really.

Sounds like your friend may have set you up. In SC everyone in the car can be charged with weed if no one claims it. How would the cops have known that you delivered it to him if had kept his mouth shut. I understand him not saying anything was his but why didn't he get charges too. Did the cops say that they were watching you or how did they decide to stop you? How well do you know your friend? I know when I get mine I put it away right away. Was your friend high when you got stopped? That might explain why he didn't put it away properly. In SC you get possession for less than an ass of weed; at least that's what my lawyer tells me. Too many people locked down for BS amounts these days. I would certainly watch my friend to see if he was a snitch and set you up. It just seems too coincidental that he's clean and you are dirty when you both had weed. Whatever you do don't start snitching yourself. Thats FUBAR!

Yeah, im from SC and no matter what whoever's car it is is getting charged. Say it was all your weed and you admit that. Both of you are getting charged. Say its all his weed and he admits that, only he gets charged. Say its only his and he doesnt admit it, both of you are goin in.

Cops are lying bastards, dont tell them anymore than they need to know and if you are riding with friends who dont know their rights or are to afraid to exercise them, then you need to educate them or find new friends.
