Hey all, this is my first post, i found this forum in my search for new york state legal information. about 2 months ago i was busted for pot, given an appearance ticket for unlawful posession of marijuana (violation). I was not arrested. Last night the same exact thing happened, i was given another appearance ticket.

I was given an Adjournment Contemplating Dismissal (ACD) the first time around when i went to court. the probationary period was one year. And last night (a month after being given the acd) i was given another ticket for the exact same thing (in a different county) and just as last time, this time i was not arrested either.

i attend college and receive financial aid, and as a result, if i am convicted of possessing any drugs, the financial aid is cut off for one year.

my question is this, is it possible to have an acd from one court and to get another acd from another court? i spoke to a lawyer and he said it is possible, but im asking again here because i want to know if anyone has actually done it. thanks guys

I know there is a case with the ACLU and not letting drug convicts attend college... you might look it up. It could also be my wishful thinking and it could just be something I read in passing.:D

I feel for you.:(

Okay, so I looked it up. It was wishful thinking... but at least some politicians are speaking up about it.

I went to college on a pell grant while I was on parole from a drug charge. The college I went to did not seem to mind the drug charge because they increased my aid every semester, because I got good grades. I graduated with a 3.9 G.P.A. all while on parole. I have had different charges in different counties and they never found out, both misdemeanors and felonies. Dont tell anyone, even your lawyer. There are so many cases before the courts that they have a hard enough time with the violent ones. I've been on summary probation in four different counties in two states and not one of the courts found out about the other, but that was all misdemeanors. Your charges all sound like that, dont sweet it and stop smoking out in public because soon or later they will become felonies and they are a lot harder to get out of. Good luck.
