School Drug Question

so my councelor calls my mom, and tells her that they think im doin drugs during school hours, is my school legally able to give me a drug test? in school, like if they ask me to take a drug test, what would i tell them?

I would imagine that would be a state to state issue....just a guess. I'd contact a lawyer for little free legal advice or go to the NORML site. Maybe they can help ya.

The school does have full authority to drug-test you IF THEY HAVE A REASON, maybe you been sleeping too much in ya classes, maybe ya been staggering or acting shady lately, maybe someone reported smelling weed on you or some shit, the school has 100% authority over you, and they can do as they please.

The school tryed to tell me that I had to take a drug before I could return from a certain offense, my dad basiclly told the administrator to shove it... and she didn't do anything about it.

you'd have to all of a sudden become really indignant and demand to know what right they had to impugn your character in such a greivous way, and the fact that it was done so publicly and without any regard to your benefit of the doubt......you could probably just get them to forget about it......side note....what sort of bullshit is that!.....if I were you I would have had serious words with that lady....that shit's not to be taken lightly.

Tell them if they don't have any solid evidence of drug use on campus (pipes, weed, stuff like that), then you won't comply with a drug test. I mean, they can't make you piss.

tell your school you will take it after every member of staff has taken 1 aswell,ill put money that atleast 1 will refuse,the whole british police force threatened to strike if they had to give these test's. hmmmm wonder what they have to hide.all police force's around the world are just goverment sponsored gangsters.

For example, EVERYONE is protected by the fourth amendment. It protects you and your posessions from search or seizure without warrant AFFIRMED by a lawful court.

On that note, at my old high school they would instantly suspend you for not consenting to a drug test. A security gaurd once plucked a student's hair without him knowing it and had the sample tested. When they tried to expell him for drug use his father threatened to sue the school for tampering with medical records (or something along those lines). Both parties dropped their respective sides of the case IIRC.

Congress passed laws long ago allowing warrantless seaches on School Property. Schools are DRUG/WEAPONS Free Zones..not Constitutional Free.

And yes, Schools can search your person on school campus...THEY CANT FORCE YOU TO TAKE A PISS TEST...They can however suspend you if you refuse.

If your parents are willing to back you up, then tell the school to FUCK OFF if they ask for a drug test. But, only if your folks are gonna back you up. Or you can retain an attorney that you pay for yourself.

It is a state to state issue. This year, my senior year thankfully, they implemented full student drug testing for everyone in sports and extra-curricular activities. Usually, if you belong to anything associated to the school name, even if its just the dang Academic Spelling Group, they can test you if they think you are doing drugs. If you don't belong to anything, no sports or activities, they have to have reasonable cause. Like someone said before, that can just be one of your teachers saying that you sleep too much in class and they want you tested, or someone saying you smell like pot etc etc. Thats reasonable cause to give you a drug test.

The only way you could probably get out of it is if your parent raised hell about it.

Technically the school can only test it's students for drugs if they have written consent from either a parent or the police (warrant). If your mother agreed to the test then you're screwed. Better start detoxing!

the only way they can drug test you is if your in some sports or extracirricular activity that requires it, dont let them threaten you about testing you if your not in anything, believe me i've been there several times
