Just wanted to take a minute to introduce myself. I am a criminal attorney in Michigan. I've had my own practice for the past 6 years and worked as a public defender for about 2 years before that in Detroit. I don't smoke marijuana anymore. I used to be an avid smoker but I quit just before my daughter was born.
I am offering advice to anyone with legal troubles or simple questions. Understand that my area of expertise is in Michigan law so I may not be able to offer any answers for other states' laws. Just let me know if I can help.

I HAVE A QUESTION!!!
i got pulled over in PA doing 93 in a 55....the cop gave me a ticket for 75 in a 55 but wrote down 93 and circled it at the bottom and said that if i tried to fight the ticket that he would come in and the judge would know i was really going 93, not 75 and id get fucked in the ass. my dad wants to take it in to "plea bargain" court and try to get the POINTS reduced, not the fine and thinks that the cop cant charge me with a 93 in a 55, because the ticket is for a 75 and he cant change that. is it worth it? can the cop/judge change it like that?

Depends on the prosecutor... generally they will make a deal, especially if you come in with an attorney. Though technically, the prosecutor may amend the ticket to address the 93 mph speed. Usually this is only done if you refuse to take their offer and want a hearing on the ticket. Your chances of getting the points eliminated or reduced depends on 2 things: (1) your driving record and (2) if you were cordial to the cop.
Cool man, I have tons of relatives in detroit. Ill let you know if there in trouble with the law lol.

If she is found with marijuana in the vicinity, it will be a violation. Since she is on probation, the court would expect her to move if she knows there is marijuana on the premises.

I got arrested last night but listen to this I was with my boy we were driving he had smoked earlier I had none i was smoking a cigarette and the cop pulled us over and serched the car he found 2 roaches a scale a nd some wrapping paper it is not my car i did not smoke the officer told me that he would give me a wipe that when he rubbed aginst my fingers if it turned orange i had been in contact with drugs i told him no problem go ahead (since I had not touched anything) He then put me in cuffs did not read maranda rights did not tell me what i was going in for but when i got the police statement it said i had possesion when there was nothing on me. This was in Maryland and this is a first offense I was let out with no bail or anything but I have to go to a commisoner hearing. Is there anything I should know or do or what can i excpect from this.

You are probably being charged under a theory called "constructive possession". This means that the prosecutor would have to prove that the substance was within your reach and you knew it was there even though you were not actually in possession. In MI, this is enough for a possession charge, especially where the officer wants to charge multiple people for the same possession. If you are a first offender, you will probably be offered a plea under advisement, which would allow the charge to be dismissed after a certain amount of time if you comply with some conditions.

I talked to my friend and he said he would go to court with me and say that i had no knowladge of the roaches some people tell me the judge may still not let me off but others say he will drop the case at that point

Hmm...Question to you: Texas man flies 431 pounds of marijuana to enid oklahoma to refuel and continue to chicago, he gets met by DEA agents, enid police, and enid narcotics unit. He gets 10 years in prison and $100,000 fine for drug traffiking. Second story: A man has been drinking heavily and is driving in the opposing lane, hits and kills a pedestrian. He gets 12 years for vehicular manslaughter. Big difference. The pilot was not going to kill anybody by bringing marijuana into the country, but he gets almost as much time as the negligent individual who took another persons life by drinking and being behind the wheel. Is this justice?

Alright heres my story...
My friends Brian and Sam were waiting at a parking lot for me and my friend. When we got there I opened my trunk pulled out some weed and proceed to head to my friends car. As soon as i hopped inside, 2 officers come up to the car and tell us to get out of the car. They assumed there was a drug deal going on so we got searched along with the car. The weed I had was stashed under the seat, but eventually found by the cops. The cops asked us about it, we all said we knew nothing about it. They also found 6 beers in the back of my friends car. They then searched my car and eventually found 2 roaches in the trunk. They wrote down our names, took our numbers, but did not give us any tickets. They left and said, be expecting a phone call. My questions are..
1) Whats a possession charge for 2 roaches in the state of michigan?
2) Will I automatically be charged for the dime in my friends car?
Id appreciate all the help!

i just got caught a couple months ago, for what they call "Delivery" the police never found money or any weed on me, nor did they see me hand it to the guy. Could they still charge me for Delivery?

If you are cought with a small amount of weed and you have not commitied any other crime in the past other than a few traffic violations, what would be an expected punishment?

The next day I saw my probation officer, he suspected I had been using the whizzinator. He required me to go straight to the drug testing facility, where I tested positive for marijuana. (I fucked up terribly.), I am 18 years old and currently taking college class's. What can I expect to happen as a result of the violation of probation? I know jail is a possibility, is there any way I can avoid jail? Please any feedback you can give me will help. I have been unable to sleep, I cannot stop thinking about whats going to happen.

i am not someone that works with the law or anything but i have got friends that have tested positive as well before
so far it's like between 1-4 months in jail then your out and back on probation for a longer term

My only question is: How does one identify a pot-friendly lawyer, like yourself, in their own state. Just in case.

Hey, Donnie. I dont know if you noticed or not, but Jcrim doesn't seem to come to the boards anymore. If he does, he has barely signed in since last spring.
Here in Texas and most other states, it's a fairly good assumption that if you find a criminal defense attorney, one who's used to dealing with and defending drug cases in the lower courts, he or she is going to be reasonably pot-friendly, as long as he's not having to try and defend someone who's been caught with huge quantities and obvious intent to distribute--or with other complicating factors, like weapons, other crimes, or more hamful drugs like meth. Attorneys know weed alone is a fairly minimal matter as legal things go, and they know there are lots better ways for courts and prosecutors to be spending their time. Usually look for someone who doesn't have a big practice yet, which means he or she will tend to take on small and medium-sized defenses, and just ask them what their attitudes are. You can usually find out a lot with an initial phone call. Legal Aid attorneys and counselors from law clinics at area law schools tend to be reasonably open-minded, too, because they help lots of young people.

Hey, im from plymouth, michigan which is in metro detroit, i got afew questions... first off, if i wash my hands does that make the drug contact swipes not turn orange? also does drug offenses really result in automatic suspensions of urmichigan operators license? any reply would be awesome! thanks! later man!
