ok so as some of you know, i went to france for 9 days.. i just started a new job but i already had the trip booked so they said i could take the time off, the day before i was going away one of my supervisors told me to have a good trip etc etc, all was ok.. then i got back on sunday, a day early, but my holiday was booked until monday so i obviously didnt go into work, i dont work on tuesdays, and normally i get one other random day off in the week, so i phoned work on wednesday and they said that wednesday was also my day off, and not to come in until thursday.. so, i woke up ready for work, got there early, walked in and straight away my supervisor walks up to me and was all like "james i need to speak to you in my office NOW" then made me wait in the cafeteria for half an hour while he "consulted the area manager" then they both come and fetch me and do this whole good cop/bad cop routine, asking questions about my where ive been.. i told them "ive been on holiday, like i told you i was gonna be before i even started working here" and they checked some little piece of paper, which was probably fucking blank anyway and were like "sorry but we dont have any record of you having a holiday booked"! when my fuckin supervisor was sittin right next to me, the same fucking guy that told me to have a good trip and he'll see me when he gets back!!!! so i was like "look, am i in shit or what? are you gonna fuckin sack me or not? tell me" and the manager said "well, in light of these events, our company has decided that youre not performing satisfactorily" and "youre not living up to our expectations" plus the fact that i took "a 9 or 10 day holiday without letting anybody know, so we've decided to terminate your contract" !!!!!!!! i didnt know what to say, so i told the "manager" to go fuck himself and walked out.. then i get home, and my aunt phones up looking for my mum so i tell her whats happened coz she works for the same company and tells me theyve been looking to fire someone, because their deadlines havent been met and theyre gettin pressure and need a scapegoat etc etc.. SO, to sum it all up, im fucking pissed off, i was lookin forward to the next few weeks coz my mums on holiday so ive got the house to myself, was gonna throw a hell of alotta parties and shit, but now ive got like NO money because i spent it all on my holiday,.. anyway, life sucks.. peace

Problem sorted.
You've got all the money you need you bonehead.

It's called unfair dismissal, and you can sue. Just so you know, I'm not one of these crazy people that walks around going, "i'll sue, i'll sue"

You actually have a legitimate case.

Firstly, you already have had the holiday and am sure you can trace when you booked the holiday and what not.
Therefore you would of booked it before you joined the company, otherwise you would of known they wouldn't let you have it, if you booked it after you joined.
Every company in the world now ask's if you have a holiday booked before they accept you, because they need to know your availability. Plus, regardless of what some shitty piece of paper says, if you are going to have a holiday, it would have to be authorised by a member of management or whatever, and a copy of your holiday booking will be kept behind in the human resources department.

So now.
:
1.We have proof, you had your holiday booked before you started work.

2.Around 99.9% of companies ask if you have any engagements in your first 3 months of work

3.If HR has a copy of your paperwork including your application, chances are it will have your details of requested holidays or even you informing the company when they are.

4.Your supervisor knew the situation and how far is he willing to take it? To court?

My honest advice would be to seek legal council in this matter,

whoa. CONTRACT? if you have a contract with this company, call a lawyer RIGHT NOW. contracts have stipulations, clauses, lots of little things to keep people from doing this kind of thing.

talk with the person who actually did the holiday booking...in my workplace, there is a large calendar that only one person is allowed to write on/erase, and it shows all the holidays that are booked (reference for people who haven't booked it off yet). basically, if you booked your holiday, there is somebody there who did it...payroll dept., secretary, personell dept, whatever...just find out who it was, and speak (nicely) with them. if they still give you hassle, raise all hell. demand to speak with the company president, and your supervisor. tell them to bring their copy of your contract, and their legal team, as well as proof that the company tried to contact you while you were gone.

always get a paper trail...call the phone company to see if you got any calls the week you were gone. if you didn't show up for a week, and the company thought you were supposed to be there, it stands to reason that they would try to find you, right?

in my humble opinion, you're being screwed because you're the new guy, and they figure you won't do anything about it...prove them wrong. its unlawful termination, and they can't do that.
