OHIO - Recently me and my friend were pulled over, he was driving and it was his car. We had been smoking some pot so they took us out of the car and checked it. A pipe was under my seat and there was a small envelope of marijuana in the door. Scattered throughout the car was a bunch of my friends paraphernalia, a small pipe, some papers, a grinder... but I had nothing on myself, it was all in the car. However, after they held us, and after my friend tried to take the claim for everything, they still gave us each a paraphernalia and possession charge, and on the ticket it lists the same thing for both of us, everything in the car. We both have court on Monday and I was wondering if anyone knows how I can get out of this.
If anyone can help asap I'd greatly appreciate it.

And you didn't seek advice from a attorney?

Dont Plea Bargain, you get screwed if you do... pay sum money to an attorney, just dont Plea Bargain...or you can go ahead and paid the fine and it be on your record regardless of what they tell you...trust me I know....

Yeah... lol, it's amazing how many people don't seek attorney's the minute they get out of jail. Even if there's a clear technicality or something to get you off the charges will stand unless you have an attorney to point it out. But from what I've heard I don't think they can charge you if you didn't have any on you and it was someone else's car.

Thing that will aply here is, was the items within the passengers reach. Thats how the courts determine want belongs to whom in a car. The passenger will get charged and maybe even convicted in this case, sorry.
