View Full Version : To smoke or not to smoke, that is the ?

Okay, here is my delima. I just got back from my last drug test down in Texas where I was caught the first time. I no longer have to worry about pissing there anymore so I am safe to smoke on that regard. On the other hand I have a trial in town this Wednesday for another charge. The prosecutor is being a dick and trying to bust me for it all cause I was 21 and the other 2 in the car were 16. The good thing is I have letters from 2 hospital stays in psych wards, letters from my psychologist and psychiatrist. I should be able to get off mostly, but I am worried that I might get drug tested down there. What does everyone think? Do you think there will be a chance if my lawyer is looking to get it all off and would you risk it or wait the few days. I want to so bad though since havent been able to without worry for 6 months. Thanks for any advice.

dude, I work in social services.....they will fuck you hard for it....just be patient....the ganja can wait....use it for a celeb when you get off man!

Trust me, i have dealt w/many judges. They use character a whole lot when judging a person. Psychiatric or not. If you are neg then they will treat you better than if you are dirty in a UA.

Can they test me that day though, or would I have to go on probation and shit like that or set up an appointment a week or so later? The trial is at 6 at night if that makes a difference.

I have had my clients tested on the same day. you are running the risk, lawyer or no lawyer. They have test sticks now that social services use in order to assess wether someone will get off or not.

Here in Texas, where I live...the judge can use his/her own discression as to wether you are prepared to get off probation.

How was your P.O.? was he/she a prick? It is usually the P.O. that orders the UA the at the time of the trial. The lawyer has no real say even if the P.O. says he/she wants a final UA. If they do the final spot UA and it comes out positive, then it will be harder for your P.O. to convince the judge to just let you off probation immediatly since you were still on probation at the time. Texas judges are pricks.

I have always dealt w/cool P.O.s at my job so i haven't had a problem w/my clients. Only twice have I had a problem and it was my client's fault since they acted like assholes in the court room when they got their probation extended for not paying their fees. Then the judge had them UAed since they acted that way and then they got more time.

I STILL WOULD WAIT MAN!!! No point at risking it.

Just get drunk or something. I don't know what else to tell you.

Well see, this is a different thing from the last charge. I am not on probation for the trial. I originally was given a ticket for paraphanalia then the prosecutor found out there was bud in the car so tried to bust me for that too. It went to court and he was being an ass about it so my lawyer said we will take to trial cause might be able to get off easier. So can they test right after a trial if I havent been convicted yet. My lawyer also said if he is still a jerk we will appeal and take to county court. Thanks for all the info. I dont know shit about the legal system.

Oh yeah, my PO in Texas was awesome. She was so nice and I am done with that stuff now, just have 6 months un-supervised proby then done. So cake walk with that.

Sadly I probably will hold off. I knew that is what I needed to hear but didnt want to at all. Thanks though for the advice, it will prob save me a lot of grief later on.
