That's right my fellow stoners. The old fuckers on capitol hill passed yet another law that has George Washington turning over in his grave. It seems now in over forty states if you get caught with a bag of weed by the police without marijuana tax stamps affixed to the bag (like your not in enough trouble at this point anyway) you will get really hammered now. You can read more informatation on this new crooked law here.

The stamp shown below is a Marijuana Tax Stamp from The State Of Minnesota. If you are caught by police with marijuana without the tax stamp you are charged with the normal penalties plus 200% payment of your unpaid marijuana tax up to $14,000 and (or) up to 7 years in prison. (So much for the goverment not being able to tax things that are illegal.) Over 40 states have new similar laws to these. The price of the tax stamps in this state are $3.50 per gram of cannabis.

So you're supposed to head to your nearest Check Cashing for a stamp whenever you buy a gram? Hahaha
You'd think that with the medical marijuana, and Denver, the laws would get a little lighter.

Drug Tax Stamp
The fact that dealing marijuana and controlled substances is illegal does not exempt it from taxation. Therefore drug dealers are required by law to purchase drug tax stamps.
The drug tax is due as soon as the dealer takes possession of the marijuana or controlled substance. Payment of the drug tax will purchase the drug tax stamps. Attach the stamp to the marijuana and/or controlled substance immediately after receiving the substance. The stamps are valid for 3 months. Drugs seized without stamps or having expired stamps may result in criminal or civil penalties which may include fines, seizure of property or liens against real estate.
A dealer is not required to give his/her name or address when purchasing stamps and the Department is prohibited from sharing any information relating to the purchase of drug tax stamps with law enforcement or anyone else.
Purchasing drug tax stamps does not make possession of drugs legal.

THE MARIHUANA TAX ACT OF 1937
http://www.druglibrary.org/schaffer/hemp/taxact/mjtaxact.htm
Marijuana Tax Stamp Laws And Penalties
??No taxation without representation? was the rally cry of advocates of American independence in the eighteenth century. Today, tens of thousands of cannabis consumers utter a similar cry over the selective and inappropriate enforcement of illicit drug taxes.
In twenty US states, those who possess cannabis or other illegal drugs are legally required to purchase and affix state-issued stamps onto his or her contraband. The total cost of the tax is generally determined by the quantity of contraband possessed. Unlike typical criminal statutes prohibiting the possession and sale of controlled substances, drug tax stamp laws primarily assess financial penalties on the defendant for noncompliance. On occasion, criminal sanctions may also be imposed.
Although nearly half of all US states have marijuana tax stamp laws on the books, few citizens observe them. Most individuals are unaware that such laws exist in their state; others fear that complying with it will incriminate their behavior. Because of this widespread noncompliance, drug tax stamps ?? unlike so-called ??sin taxes? on alcohol or tobacco ?? do not collect state tax revenue at the customer??s ??point of purchase.? Rather, the legislative intent of drug tax laws is to impose an additional penalty ?? tax evasion ?? upon drug offenders after they are arrested and criminally charged with a drug violation.
In some states such as Georgia, failure to comply with the state tax law may result in a nominal misdemeanor penalty. However, in other states such as Minnesota, failure to comply with the state??s drug tax law may result in a defendant facing an additional fine of up to $14,000 and seven years in jail.
See State Tax Stamp Data for the current state penalties for violating marijuana tax laws and additional information regarding a particular state's law.

It's not a blue law. It's a new law.

Its not that its new but rather resurfaced in the public arena for discussion.
It has been in the books for years but not enforced. A few states have had people challenge it and it was upheld, yet mostly ignored after that. I read about it some time ago.
But isnt is an ass backwards law? A silly assumption to imagine people would comply.
It's more of just a way to grab at money from your pocket when you fail to comply. Another way to hit you. It was a good idea as far as it goes when it was put to law because it had the potential to contribute to the finances of the 'war on drugs'. For this I am suprised it wasnt used and overused. Grab some coin off every guy you pinch and put it into the coffers.
Our current version of that in Canada is that under 30 grams is decriminalized as personal use and you will get a fine for it. That money goes to the enforcement of narcotics laws.

In the states that enforce these laws, the police notify the taxman so they can send you a bill. You don't have to be convicted. You get a bill in the mail which must be paid or you will end up in court where they will take your assets.

ok since noone else so far has put it, I will explain this. One of the big reasons behind the government keeping this tax stamp law is that if you get caught with marijuana on you and no tax stamps (which attampting to purchase would get you arrested anyway), they can also add Tax Evasion to the charges against you. Its a very sneaky way of giving them an ability to further worsen your penalties.

Look, this is the way to do it EVERYONE GO OUT AND BUY ALOT OF THESE. Once the govt. realizes the sheer volume of potsmokers in the U.S. It will be able to consider legalizing it.

11-29-2005, 04:47 AM
see the whole problem was that there wasnt enough legislation regarding weed. it was just schedualed and thats it. now if you introduce new laws like this it opens up the possibilty for loop holes and ways to get around this legality shit.
i bet the next step is gonna be making tiny amounts legal like 1-2 grams.
