Today I was arrested for a bogus charge i need help!!! The Cop was flashing his lights at me but it were his head lights not emergency lights at all. also rights were never read. before i was arrested i was in cuff never gave consent to vehical search and had my car completely ravaged from engine to trunk only to find an old blunt wrap and roach which i have no idea how it got there it took over 25 min to seach the whole car with two cops i was in warrior county alabama going south on 65. then we has at least 4 hrs over my bail money was wstrn unioned to me. much more crazyness to the story but i need help finding a attorney. if anyone knows how to approach this i would appreciate it. i have two charges on for the roach and one for blunt wrap in a still sealed package then i was off to jail. i was in the car handcuffed before i was arrested. thank you for the coming replies. also his me at aim thirdeye46in2 and

how does a blunt wrap get u a charge? I thought those were legal.

not when they find it with some smoke or in his case a roach. Doobie, why were you pulled over in the first place?

Sugarmagnolia, because they found the roach(weed) the blunt wrap is considered marijuana paraphinalia. So hes getting charged for both the weed and the wrap.
And to answer Doctahdoobies question i would go to www.Norml.org and look under the find a lawyer tab(on the left on the main page). If that doesnt work i would recommend you look in the yellow pages.
I would say Because they had no probable cause the evidence might not be admissable in court, also because you rights were not read. But then again the cops could always say, "I smelled the strong odor of marijuana eminating from the vehicle." Thats exactly what one said to me, but he didnt find shit.
Fuck those pigs, and next time dude i would reccomend you make sure to have absolutely no weed in your car so this wont happen again.

Get a lawyer, either through NORML or through your own yellow pages search. What the police did is illegal and the "evidence" will not be admissable in a U.S. court. If you had given consent to search, then yes it would have been. However, without consent being given, there's little they can legally do without calling in the dogs to get a warrant. I assume they didn't call in the dogs, as there was no mention of that, so that means what they did was an illegal search and seizure. Same thing happened to my friend's dealer, on his way back from Illinois he was pulled over and illegally searched. They found 3 lbs of White Widow and another 2 lbs of shrooms in his car, but he got off because it was an illegal search and seizure.
My advice is to go through NORML, like rysk8er420 said. If not, just browse the yellow pages.

Cops dont have to have consent, all they gota say is they smell it, your word against 2 cops, and the fact they DID find stuff just makes your case harder to proove. And besides dude, if you would have said No to consent, they would have just kept you there till they got a Dog/Warrant. Either way your chit out of luck. Enjoy probation. And the above case, no1 is being pulled over with with 3 lbs of weed and shrooms to boot, and getting off, because he was transporting it across state lines more than likely, which makes it a Felony and a crime has already been committed, So cops have total authority to search your car.

Yeah man, the cops do not have the authority, but the cops are corrupt. It all depends on the best attorney that you cna afford. My mom's attorney got a guy off crossing the Nogales border with 100 lbs of schwagg - doesn't matter. He got 30 days in jail but the defense work cost him $80,000, so I'm pretty sure you can get off easy man. God the fuckin' cops I HATE I HATE I HATE them. Like the guy said above me they will proabably not allow such evidence in the court. CHECK to see if they video taped the whole thing through the cops car camera, that will be your biggest alibi. I will be going to law school in a bout 1 1/2 years after I complete my undergrad work, but when I do I seriously would like to prosecute the cops.

You obviously know jack-shit about Criminal Justice. Go take a few classes, read a few books, and come back and talk. In the above case, it did happen, and yes it WOULD have been a felony. Unfortunately, the cops in the above situation did an ILLEGAL SEARCH AND SEIZURE. As in, they did not have a warrant, they did not smell an odor, and they did it on mere suspicion, which no US law figure can do besides CUSTOMS AGENTS. I'm sorry Tholiak, but I guessed as to an illegal search and seizure as his article made no mention of the cops smelling anything. And not all cops can/will call out the K-9 units on mere suspicion, as it can be costly.
p.s. - look up some shit on illegal search and seizure and "fruit of the poisonous tree", tholiak. jackass. :rolleyes:
